Transboundary Groundwaters: The Bellagio Draft Treaty, Robert D. Hayton, Albert E. Utton

Increasing populations and industrial and agricultural development worldwide are placing much greater demands on groundwater supplies. Many of these groundwater basins or aquifers underlie two or more countries and are, thus, international or transboundary. Withdrawals from one country can drain life-giving water from a neighboring country and, as a consequence, be the source of severe and protracted conflict. Unfortunately, international law and treaty practice are only at a beginning stage. With the goal of advancing international law and institutions on the matter, a multi-disciplinary group of specialists over an eight-year period have developed a draft international groundwater treaty.

The implementation of environmental law and policy has assumed that pollution could be contained, corralled and interdicted within the medium (air, land, or water) in which unpleasant effects are encountered. Sweeping, but piecemeal, federal legislation in the 1970s aspired to create healthy air, together with fishable, swimmable and drinkable waters. Despite impressive gains, these goals have not been achieved. There have been painful failures, compounded by the mounting costs of environmental protection. While the need for environmental protection is generally accepted, the effectiveness and efficiency of regulation based on the legislation of the 1970s has been questioned in the 1980s. …

Terrorism is a phenomenon in the contemporary world which occupies the attention of the international community. Terrorism as an international crime is readily more comprehensible and susceptible of clearer definition than sheer acts of terrorism by whomsoever performed. This paper is confined to questions of responsibility and complicity in connection with terrorism as an international crime, whatever the definition is ultimately adopted of "terrorism," and whatever the meaning to be ascribed to an "international crime."

This report is the seventh in the series of reports on jurisdictional immunities of States and their property submitted to the International Law Commission by the Special Rapporteur. This article provides a substantive discussion of international human rights law and how it can be used in federal and state courts to protect human rights within and outside the United States. It provides a comprehensive analysis of cases and examples of possible areas in which international human rights standards may be used to interpret United States laws. Thirty-six years have elapsed since the Rio Grande Compact of 1938, N.M.S.A. Section 75-34-3 (Repl. 1968), was entered into by Colorado, New Mexico, and Texas, and approved by the United States of America. Administration of the Compact since then has been the responsibility of many different persons, few of whom had personal knowledge of the circumstances of the negotiation of this Compact. Consequently, there has been a growing tendency towards interpretation of some of the provisions of the Rio Grande Compact in a manner contrary to the intent of those who participated in its negotiation.

Much has been written about the various methods of pacific settlement of disputes specifically mentioned above. But very little literature can be found on "other peaceful means of their own choice." It is the purpose of this modest essay thus to supplement to some extent the missing link by an effort to throw some light on one of the pacific procedures not enumerated in the Charter, but is nonetheless growing in usefulness and popularity over the recent years.
