The Role Of The United Nations In Dealing With Global Problems, Jost Delbruck

Indiana Journal of Global Legal Studies

In this article, Professor Jost Delbruck maintains that the United Nations

(U.N) has evolved beyond its original conception as merely an international

organization designed to facilitate cooperation between its various Member

States. As evidence of this transformation, Delbruck offers examples of UN.

practice and its impact. In particular, UN. regulation concerning global

commons and human rights has encouraged globalization by confirming

limitations on States' rights and sovereignty. Further, the UN. practice of

involving non-governmental organizations has helped to expand (or globalize)

the recognized subjects of international law.

Professor Fidler's article examines the Cuban Liberty and Democratic

Solidarity (LIBERTAD) Act of

1996,

Act, from within liberal international relations theory. He takes as his starting

point the controversy that the Helms-Burton Act has produced among liberal,

democratic states. Professor Fidler outlines the major tenets of the liberal

tradition in international relations thinking: promoting economic

interdependence, internationall aw, internationali nstitutions,a nd democracy.

He then looks at the arguments made by opponents of the Helms-Burton Act

Stop Stomping On The Rest Of Us: Retrieving Publicness From The Privatization Of The Globe, Zillah Eisenstein

Professor Eisenstein's article discusses the effects of globalization on the

relationship between privatization and public responsibility and how this

dynamic impacts the future of women across the globe. She argues that the

global growth of privatization in the North and West has disseminated around

the world to the detriment of women. Privatization, she contends, has been

accepted as the agenda of politicians for the late twentieth century, and public

responsibility has been lost as a result.

Enforcement And The Success Of International Environmental Law, Mary Ellen O'Connell

Indiana Journal of Global Legal Studies

Professor O'Connell discusses the tradtional methods used for international law "enforcement," and she argues that international law is generally obeyed Its enforcement is based primarily on compliance, not enforcement. Accordingly, the author argues against using international enforcement mechanisms to enforce international environmental law. Instead, she posits that domestic courts should be used for international environmental law enforcement, however, certain obstacles, such as sovereign immunity, the doctrine of standing, and the principle of forum non conveniens, must be overcome. Professor O'Connell argues that it may be possible to overcome many of these court-made obstacles to enforcing international law through domestic courts. …

inaugural lecturer for the Ralph F. Fuchs lecture series at the
