Perhaps no member of the legal academy in America is more controversial than John Yoo. For his role in producing legal opinions authorizing what is thought by many to be abusive treatment of detainees as part of the Bush Administration’s “Global War on Terror,” some have called for him to be subjected to professional discipline, others have called for his criminal prosecution. This paper raises a different question: whether John Yoo – and his like – ought to be teaching law.

Concern over the academic talent development of Division I student–athletes has led to increased research to explain variations in their academic performance. Although a substantial amount of attention has been given to the relationship between student–athletes and their levels of academic success, there remain critical theoretical and analytical gaps. The purpose of this article is to develop a conceptual model to understand and explain the cumulative processes and characteristics—as a whole and in stages—that influence academic success for Division I student–athletes. The situation of women in Israel is a complex one. While in many respects women enjoy advanced liberal citizenship rights, in other respects, especially in the domain of personal status law, they suffer from serious restrictions on their rights and from discrimination. I will argue that this discrimination is the result of Israel's commitment to maintaining its character as a Jewish state through a preservation of a Jewish majority in Israel. This commitment results in legal restrictions on the right to marry and on the right to have an abortion, both of which, as I will show, are strongly related …

Ricci v. DeStefano is the most important recent Supreme Court pronouncement on one of the landmark enactments of the 1960s, Title VII of the Civil Rights Act of 1964. The decision, authored by Justice Anthony Kennedy, held that the white firefighters who topped the civil service list by virtue of their test scores were entitled to promotion, notwithstanding the disparate impact the test had on African-American candidates. The case has the potential to significantly curtail impact litigation under the statute, and certainly will discourage employers from monitoring their selection devices to remove “artificial, arbitrary, and unnecessary barriers to employment when …

This Essay introduces the “Anti-Interference Principle” – a new term on the meaning of equality, or at least one not yet so-named in the equality lexicon – as a necessary foundation for achieving the goal of true equality. Equality has a long-standing place in the discussion of politics and jurisprudence and remains a struggle of definition today. Rather than rehash the mass of scholarship, this Essay seeks to summarize the general equality concept, and propose that the legal discourse on equality center on a requirement that governmental power must protect and respect equal treatment and opportunity, unconstrained, not equal outcomes. …

The meaning of the word “conclusory” seems really, quite elusory. Conclusory is a widespread, common, and effusive word in the modern legal lexicon. Yet you would not necessarily know that by looking through many dictionaries. “Conclusory” has been a late comer to the pages of most dictionaries. Even today, not all dictionaries include the word “conclusory”, those that do have only recently adopted it, and the small number of available dictionary definitions seem to struggle to capture the word’s usage in the legal world. The Bush administration's so-called war on terror needs to be situated within the context of earlier efforts to demonize dissent. Since the early 1970s the FBI has increasingly linked the threat of terrorism to lawful domestic social movements to undermine their legitimacy and blur meaningful distinctions between violent and peaceful political activity. In recent years, the FBI has become the leading control agency in what scholars and popular writers term the “surveillance society.” The FBI monitors public spaces and has deployed increasingly sophisticated technological surveillance. The bureau also has developed a new “preventative paradigm,” viewing well-nigh all street protest as …
