Can juror bias be predicted after a thorough voir dire is conducted by a trained forensic psychologist? Most cases involve complex laws that require jurors to be more critical and thoughtful about their decisions and ultimately their verdicts. It is not enough to observe a jury pool and assess non-verbal cues. A trained trial consultant must have the psychological background to completely predict behavior of jurors based not only on non-verbal behaviors but also on socioeconomic, racial and gender factors as well as experience. All jurors are biased, but it is the trial consultant's duty to filter through those biases …

Curry On Long, 'Mapp V. Ohio: Guarding Against Unreasonable Searches And Seizures' (Book Review), Lynne E. Curry

In June, 1961, the U. S. Supreme Court delivered its opinion in Mapp v. Ohio, thereby launching the "due process revolution" in which the Court, under Chief Justice Earl Warren, expanded the universe of rights and protections guaranteed to individuals in the criminal justice system. Justice Tom C. Clark's majority opinion held that the "exclusionary rule," by which judges barred evidence gathered in the course of violating the Fourth Amendment's protections against unreasonable searches and seizures from being entered in federal trials, was constitutionally required and thus also applied in state criminal proceedings. The United Nations Development Program and the Republic of the Maldives, a small Muslim country with a constitutional democracy, commissioned this project to craft the country's first system of codified penal law and sentencing guidelines. This Article describes the special challenges and opportunities encountered while drafting a penal code based on Shari'a (Islamic law). On the one hand, such comprehensive codification is more important and more likely to bring dramatic improvements in the quality of justice than in many other societies, due in large part to the problems of assuring fair notice and fair adjudication in the uncodified Shari'a-based system …

Opposing The Lottery In The U.S.: The Forces Behind Individual Attitudes Towards Legalization In 1975, Andrew J. Economopoulos

In the 1970s, opposition to the lottery started to fracture in the US. This study examines causes of the fracture and historical factors that contributed to changes in individual attitudes towards legalization. The opponents at the time held to traditional arguments against legalized lotteries—negative economic effects, costs to others and increased crime. Unlike in the past, however, there was weak religious institutional opposition to lotteries. Individuals with a strong commitment to their religious affiliation were more resistant to pro-lottery arguments, but in most cases could be convinced to support the lottery. The Riddim Method: Aesthetics, Practice, And Ownership In Jamaican Dancehall, Peter L. Manuel, Wayne Marshall

The Jamaican system of recording and performance, from the 1950s to the present, constitutes a distinctive approach to notions of composition, originality and ownership. Emerging from a tradition of live performance practice mediated by (and informing) sound recordings, the relative autonomy of riddims and voicings in the Jamaican system challenges conventional ideas about the integrity of a song and the degree to which international copyright law applies to local conceptions, as enshrined in decades of practice, of musical materials as public domain. The handbook should be used as a resource for assistance during investigations of sexual assault. The handbook is structured chronologically by the 'standard' timeline of procedures associated with a rape investigation after receiving the initial report. As no two reports are alike, the handbook should be used as guideline to what might occur at the time of report. The handbook is further divided by the role of the user. A Contractarian Argument Against The Death Penalty, Claire Oakes Finkelstein

Opponents of the death penalty typically base their opposition on contingent features of its administration, arguing that the death penalty is applied discriminatory, that the innocent are sometimes executed, or that there is insufficient evidence of the death penalty’s deterrent efficacy. Implicit in these arguments is the suggestion that if these contingencies did not obtain, serious moral objections to the death penalty would be misplaced. In this Article, Professor Finkelstein argues that there are grounds for opposing the death penalty even in the absence of such contingent factors. She proceeds by arguing that neither of the two prevailing theories of …

Art Imitates Life: Violence And The Music Of Metal And Rap, Gordon A. Crews, Angela D. Crews

Criminal Justice Faculty Research

The purpose of this presentation is to explore the similar evolution's of Black Metal and Gangsta Rap musical genres. The authors argue the following similarities exist: 1) different cultures and statements being made, but violence is a common thread (outcomes of violence and societal responses), 2) the music and lyrics in both reflect their cultures, histories, and lives, and, 3) there is a strong musical and lyrical expression of violence related to the behavioral expression of violence among the artists and the fans in both genres. Finally, the authors question whether art imitates life or life imitates art.
