Understanding Judicial Discretion, Barry Hoffmaster

The main aim of this paper is to clarify the dispute over judicial discretion by distinguishing the different senses in which claims about judicial discretion can be understood and by examining the arguments for these various interpretations. Three different levels of dispute need to be recognized. The first concerns whether judges actually do exercise discretion, the second involves whether judges are entitled to exercise discretion, and the third is about the proper institutional role of judges. In this context, the views of Dworkin, Raz, Perry, Greenawalt, and Sartorius are examined. Finally, it is suggested that a resolution of the judicial …

Poem XXXII, Trilce, written by the Peruvian poet César Vallejo, appeals to the sounds of words and onomatopoeic expressions (rather than to their actual meaning) to both move and shock the listener and make him/her aware of the particular situation the work presents. The extensive use of nonsense words and harsh sounds makes this work very difficult, if not impossible, to translate without altering the effect of the poet’s intention.
Two opposite dimensions are dealt with in the poem. The first, reality or the outer world, is symbolized by heat and warmth. It expresses chaos, oppression, injustice, and the absurd …

Few of Horace's Odes have occasioned as little recent critical commentary as his poetic pledge to die along with Maecenas. Although a profitable direction for analysis was indicated by Meineke's outraged condemnation of the fourth stanza and PEERLKAMP'S even earlier obelization of a full five of the poem's eight stanzas, the road most commonly taken by critics has been to ignore this ode altogether, or to mention it in passing only. Of the most recent studies on Horace, only FRAENKEL and (necessarily) NISBET and HUBBARD'S exhaustive commentary on Odes II meet the poem head on. Critics' difficulties with the ode …
