Chaos, madness, all that overtakes or destroys the norm, anchors fiction in an attempt to reorganize reality and the imaginary.

Devolution: The Retreat Of Government, Judith Kurland

Devolution as practiced in much of the world is decentralization of program authority and responsibility to achieve greater administrative efficiency or program standards. Devolution as practiced by the Bush administration and the Republican Congress is not that, nor is it a diminution of federal power and the strengthening of states’ rights. Rather, it is a radical restructuring of government to prevent the expenditure of funds for traditional Democratic programs of the New Deal and the Great Society, and to prohibit states from being either more generous in social programs or more stringent in regulating industry than this administration desires.

Legislative casework is an ongoing activity in many state and federal legislative offices. Although the activity carries the implication of being a social work activity, there is little evidence from the literature, or in the field, that social workers are more than marginally employed in these positions. Reasons for the lack of professionally educated social workers in this important area of practice and politics are not clear. This paper explores the field of practice known as legislative casework, its history and purpose, and presents generalist social work examples from a Congressional district office wherein which professional social workers are employed. …

In the past decade, corporate targets of American investigative reporting have deployed new legal and public relations counter‐attacks on journalists. Although corporations have largely directed their efforts at managing subsequent news coverage of these controversies, there has been no systematic study of how the rest of the media cover them. We examine elite print reaction to two investigative reports that were publicly challenged by their targets: ABC's 1992 Primetime Live report on Food Lion supermarkets and NBC's 1992 Dateline NBC story on General Motors' trucks. What Is Fiscal Responsibility? Long-Term Deficits, Generational Accounting, And Capital Budgeting, Neil H. Buchanan

This article assesses three basic approaches to assessing the future effects of the government’s fiscal policies: traditional measures of the deficit, measures associated with Generational Accounting, and measures derived from applying Capital Budgeting to the federal accounts. I conclude that Capital Budgeting is the best of the three approaches and that Generational Accounting is the least helpful. Acknowledging that there might be some value in learning what we can from a variety of approaches to analyzing fiscal policy, I nevertheless conclude that Generational Accounting is actually a misleading or--at best--empty measure of future fiscal developments. The architect Daniel Libeskind has written a noted lecture, "Traces of the Unborn." We might add, "Traces of the Stillborn." There is a tendency in historical institutionalism (HI) to concentrate on the retrieval of traces of paths taken rather than (1) to consider the processes involved in the selection of paths; and (2) to reflect upon the conditions of institutional emergence and sedimentation of paths, whether taken or untaken. Senator and presidential contender John Kerry has loudly and critically clanged the intelligence-reform bell in President Bush's ears. Recently, Mr. Kerry proposed great expansion of the director of central intelligence's (DCI) authority over the National Security Agency, Defense Intelligence Agency and National Geospatial-Intelligence Agency. But true reform must first come with the DCI's emancipation from the White House through providing a 10-year term as a presidential appointee.

Mixed Signals: Reconsidering The Political Economy Of Judicial Deference To Administrative Agencies, Matthew C. Stephenson

This paper investigates rational choice explanations for patterns of Supreme Court decision-making with respect to the appropriate level of judicial deference to administrative agency decisions. In particular, I assess empirically the thesis that the Supreme Court expands deference when the Supreme Court is ideologically closer to the executive than to the circuit courts, and contracts deference when the opposite is true. I find little to no evidence supporting this "rational choice" theory of judicial deference. Given this surprising null finding, I offer alternative explanations for the data and suggest directions for future research.

This article presents evidence of name-order effects in balloting from a study of the 1998 Democratic primary in New York City, in which the order of candidates' names was rotated by precinct. In 71 of 79 individual nominating contests, candidates received a greater proportion of the vote when listed first than when listed in any other position. In seven of those 71 contests, the advantage to first position exceeded the winner's margin of victory, suggesting that ballot position would have determined the election outcomes if one candidate had held the top spot in all precincts.

This essay aims to consider the scope of tolerance and its moral reasoning. I first discuss the reluctance of prominent philosophers to prescribe boundaries to liberty and tolerance. I then focus attention on Rawls’ discussion on tolerance, which I find quite disappointing, yet argue that his line of reasoning on the question of tolerating the intolerant contributed to the very fashionable consequentialist approach. After criticizing the consequentialist reasoning I introduce an alternative approach: the principled reasoning. I explain that much of the liberal reasoning is inspired by the fear of sliding down the slippery slope, and finally turn to discuss …

President [Bush], in a convoluted response to a question on the meaning of tribal sovereignty (essentially the inherent right of indigenous nations to self-governance) posed by a minority journalist on August 6, told the 7,500 assembled journalists that "tribal sovereignty means that it's sovereign. You're a—you've been given sovereignty and you're viewed as a sovereign entity. And therefore the relationship between the federal government and tribes is one between sovereign entities."

This dissertation is a study of the thought of Michael Oakeshott with particular emphasis on his writings about the character of religion and aesthetics. The dissertation as a whole makes the case that a certain moral vision-one informed by religious and aesthetic considerations-lies at the center of Oakeshott's thought and informs his political philosophy. The dissertation begins as an examination of Oakeshott's debts to St. Augustine and to British Idealist thinkers such as F. H. Bradley, and moves to a study of Oakeshott's own views on religion and aesthetics. It turns next to a consideration of Oakeshott's two essays entitled …

This article is a reply to Thomas Hazlett’s commentary on my article entitled, “Rethinking the Commitment to Free, Local Television.” Although politics and public choice theory represent an important approach for analyzing government actions, economic policy still exercises some influence over the regulation of television. On the one hand, we agree that the regulatory preference of free television and local programming is more a reflection of political considerations than economic policy and that the importance of promoting communities of interest over geographic communities, and the potential for new services such as Digital Audio Radio Services to benefit consumers. Musical Play Across Ethnic Boundaries In Western Jamaica, Ronald Eric Dickerson

An ethnography of music, ritual, and festival in western Jamaica, this thesis reports on fieldwork performed in St. Elizabeth and St. James Parishes between June 2002 and January 2003. Featured field sites include rural dancehall events, Kumina performances, Accompong Town's Maroon Heritage Festival, and a Rastafarian music and nutrition festival called "The Supper of Rastafari." Building an account of these and other sites of cultural performance, this study focuses on social connections between groups of participants, traced through poetic, historical, and personal relationships among performers, especially across boundaries of ethnic, stylistic, or religious difference within Jamaica's national cultural identity.
