Adulthood In Law And Culture, Vivian E. Hamilton

Young people today come of age in a cultural and economic milieu that prolongs their attainment of the traditional markers of adulthood. Their subjective conceptions of the transition to adulthood also depart radically from the traditional conception, with its emphasis on discrete transition events (including marriage and entry into the workforce). Instead, the modern transition to adulthood is a gradual process comprising the acquisition of general capabilities, rather than the achievement of externally constructed events. The state-established age of legal majority stands in marked contrast to this gradual and prolonged process. Not only does it categorically establish the inception of …

On Hart's Category Mistake, Michael S. Green

This essay concerns Scott Shapiro’s criticism that H.L.A. Hart’s theory of law suffers from a “category mistake.” Although other philosophers of law have summarily dismissed Shapiro’s criticism, I argue that it identifies an important requirement for an adequate theory of law. Such a theory must explain why legal officials justify their actions by reference to abstract propositional entities, instead of pointing to the existence of social practices. A virtue of Shapiro’s planning theory of law is that it can explain this phenomenon. Despite these sympathies, however, I end with the suggestion that Shapiro’s criticism of Hart, as it stands, is …

Eternal Recurrence In A Neo-Kantian Context, Michael S. Green

In this essay, I argue that someone who adopted a falsificationism of the sort that I have attributed to Nietzsche would be attracted to the doctrine of eternal recurrence. For Nietzsche, to think the becoming revealed through the senses means falsifying it through being. But the eternal recurrence offers the possibility of thinking becoming without falsification. I then argue that someone who held Nietzsche’s falsificationism would see in human agency a conflict between being and becoming similar to that in empirical judgment. In the light of this conflict only the eternal recurrence would offer the possibility of truly affirming life. …

Drawing on American Kennel Club (AKC) puppy registration numbers for approximately 82 varieties of pedigree dogs between 1926 and 2005, the current article analyses behavioural reports on 32,005 dogs of these varieties reported through the Canine Behavioural Assessment and Research Questionnaire (C-BARQ). Cluster analysis of C-BARQ scores indicates that the 82 breeds fell into six clusters. Average scores for each of the 14 behavioural subscales and 22 miscellaneous traits in C-BARQ were calculated for each cluster, and the breeds in each cluster with average scores most similar to the cluster averages were selected as titular breeds. The market-oriented economic reforms that started in 1978 have greatly transformed the Chinese economy. State-owned enterprises (SOEs) were allowed to operate and compete on free market principles, rather than under the direction and guidance of state planning; special economic zones were established along the coast for the purpose of attracting foreign direct investments, boosting exports, and importing high-technology products; and, private enterprises were legalized and promoted. With these reforms, the average annual growth rate of China’s real GDP was close to 10 percent from 1979 to 2007, compared to a prereform growth rate of around 5 percent from 1960 to …

Consumer Complaints And Public Policy: Validating The "Tip-Of-The-Iceberg" Theory, Drew Hyman, John Shingler, Mitchell Miller

This article examines data from a statewide study to test whether organizational aberration theory or systemic pattern theory is supported by data on complaining. The article concludes that citizen and consumer complaints can serve both as early-warning and fail-safe functions leading to increased accountability and safer, more effective, high quality processes, products, and services.

Due to the routine use of the filibuster and related devices, today’s Senate operates as a supermajoritarian body. This Symposium Article considers whether this supermajoritarian aspect of the Senate renders it dysfunctional and, if so, what can be done about it. I contend that the Senate is indeed broken. Its current supermajoritarian features have pernicious effects. Further, and contrary to the claims of many of the Senate’s defenders, this aspect of the Senate is not part of the original design. I go on to explain why the Senate’s procedures, despite their deficiencies, have nonetheless proven resistant to reform. The impediment …

This study intended to examine the impact of the gardening curriculum in an urban elementary school in Cleveland, Ohio. This yearlong gardening education program is introduced to the students in the 4th grade and incorporates a curriculum that includes gardening, nutrition, community service and experiential learning. Pakistani politics are characterised by strong corporate social links through kinship and caste that impose reciprocal obligations and rights. Marital maps enable allow for accurate prediction of allegiances and decision making and contribute to a transparent assessment of political processes in the country. While much of the focus on reciprocal relations has understandably been on descent relations (dynasties), the complex network of marital alliances that cut across lineage and sectarian divides helps explain notable levels of stability despite the fragility of the state and other public institutions. The intent of US federal laws mandating IACUC review of animal-related activities was to satisfy contemporary socioethical concerns by introducing deliberations about ethics and animal welfare into the research process when animals are used. These laws and the system they chartered have worked well for the most part in providing opportunities for consideration of animal welfare as a vital part of animal research. As a result, investigators today are far less naïve about the ethical issues raised by research on animals and typically more sympathetic about the need for such consideration.
