On October 26, 2012, the University of Akron School of Law’s Center for Intellectual Property and Technology hosted its Sixth Annual IP Scholars Forum. In attendance were thirteen legal scholars with expertise and an interest in IP and public health who met to discuss problems and potential solutions at the intersection of these fields. This report summarizes this discussion by describing the problems raised, areas of agreement and disagreement between the participants, suggestions and solutions made by participants and the subsequent evaluations of these suggestions and solutions.

La “Teoría de la Adicción Racional” y el denominado “Modelo de Inconsistencia Temporal de la Adicción” son los enfoques teóricos dominantes en la economía que tratan de explicar la dinámica del consumo de cigarrillo entendido este como un producto que genera adicción. Aunque la estructura de estos dos enfoques son ciertamente similares, las implicaciones de utilizar uno u otro modelo son bien diferentes, particularmente en lo relativo al criterio normativo relativo a la intervención del Estado respecto de la conducta individual en el mercado. Towards A New Moral Paradigm In Health Care Delivery: Accounting For Individuals, Meir Katz

For years, commentators have debated how to most appropriately allocate scarce medical resources over large populations. In this paper, I abstract the major rationing schema into three general approaches: rationing by price, quantity, and prioritization. Each has both normative appeal and considerable weakness. After exploring them, I present what some commentators have termed the “moral paradigm” as an alternative to broader philosophies designed to encapsulate the universe of options available to allocators (often termed the market, professional, and political paradigms).
