The Sour Truth: Maine's Refusal To Provide Agricultural Workers Equal Employment Rights By Statutory Exclusion, Natalie Jump

Agricultural work is some of the most dangerous and grueling work there is, but you wouldn't know that from the way Maine's wage and hours laws have treated agricultural workers, both historically and today. Until 2025, farmworkers were not entitled to Maine minimum wage and were guaranteed only the significantly lower federal minimum wage. The Maine State Legislature decided that agricultural workers deserved more and passed a law during the first session of the 132nd Legislature that required agricultural workers to be paid Maine minimum wage. However, agricultural workers remain statutorily exempt from the definition of "employee" and therefore still …

Taking Back Control: Using The Takings Clause To Hold Animal Agriculture Responsible For Its Waste Problem, Rowan Aragon

Between the mid-twentieth century and modern day, the animal-agriculture model has shifted from small farms to industrial operations. During that evolution, the negative externalities of animal-farming practices have intensified. One of those externalities—animal waste—has become particularly problematic. Because of the sheer number of animals raised in the United States for slaughter and dairy production, the magnitude of animal waste produced is overwhelming. To deal with this problem, animal farmers often liquefy the animal waste and then spray it onto open fields. In that spraying process, liquefied animal waste carries through the air and reaches nearby homes, coating those properties with …

Distributive Justice And Rural America, Ann M. Eisenberg

Today’s discourse on struggling rural communities insists they are “dying” or “forgotten.” Many point to globalization and automation as the culprits that made livelihoods in agriculture, natural resource extraction, and manufacturing obsolete, fueling social problems such as the opioid crisis. This narrative fails to offer a path forward; the status quo is no one’s fault, and this “natural” rural death inspires mourning rather than resuscitation. This Article offers a more illuminating account of the rural story, told through the lens of distributive justice principles. This Note aims to identify the food justice issues caused by the National Bioengineered Food Disclosure Standard (NBFDS) and make recommendations for the United States to minimize these concerns. The NBFDS requires the United States Department of Agriculture (USDA) to draft regulations establishing a mandatory disclosure standard for GM food and ultimately, will require a disclosure on the package of any GM food sold in the United States.
