In a year charged with worldwide exhilaration, the wall of sophisticated repression crumbled and free jurisprudential passage prevailed across litigational checkpoints previously fraught with the deadly terror of ignorance. In an atmosphere literally saturated with analytical amazement, Georgia local government law declared its independence from stultifying mediocrity. Laying siege to ambivalence the subject demanded high profile recognition in both judicial and legislative diplomacy. On this map of legal terrain, the cases are loosely marshalled by topic and the posted statutes are all general ones. It would not be prudent at this juncture to reveal more.

Plans, Protections, And Professional Intervention: Innovations In Divorce Custody Reform And The Role Of Legal Professionals, Jane W. Ellis

University of Michigan Journal of Law Reform

Beginning with an overview of the "law in theory" in Part II, this Article describes the Parenting Act's political origins and the aspirations on which the Act was based. These aspirations reflect common contemporary national themes and are based on common (and often unexamined) assumptions about the purposes of custody law and, indeed, the nature and capacity of law itself. They are described in conjunction with major theoretical arguments about custody reform. Part II then sets out the specific regulations embodying the drafters' goals. Despite the injection of new taxes in the amount of $1 .2 billion in fiscal 1991, and recently announced cuts in the budget of approximately $464 million, the Commonwealth's fiscal condition - irrespective of the outcome of CLT's petition -is precarious. Although the political juices are flowing in Massachusetts, with an eye on November 6th, Massachusetts decision-makers have not faced up to the problems inherent in the long-term, structural spending patterns of the state's budget.

Our five-year budget projection indicates that if expenditure trends continue without dramatic restructuring - particularly in the "non-discretionary" accounts - the Commonwealth faces a steady …
