A Tragédia Do Judiciário: Subinvestimento Em Capital Jurídico E Sobreutilização Do Judiciário, Ivo T. Gico Jr.

Esta tese explora o subinvestimento em capital jurídico como uma explicação para o problema de congestionamento dos tribunais brasileiros. A análise indica que os magistrados brasileiros não possuem incentivos e mecanismos suficientes para investir em capital jurídico e uniformizar regras jurídicas. A insegurança jurídica resultante, combinada com o livre acesso ao serviço publico adjudicatório constitucionalmente garantindo, gera incentivos para a sobreutilização dos tribunais, resultando no problema endêmico de congestionamento, a Tragédia do Judiciário. O congestionamento atrai litigantes que desejam postergar suas obrigações pelo sistema judicial, enquanto litigantes legítimos são excluídos, um problema trágico de seleção adversa.

Legal scholars, economists, and political scientists are divided on whether voter initiatives and legislative referendums tend to produce outcomes that are more (or less) majoritarian, efficient, or solicitous of minority concerns than traditional legislation. Scholars also embrace opposing views on which law-making mechanism better promotes citizen engagement, registers preference intensities, encourages compromise, and prevents outcomes masking cycling voter preferences. Despite these disagreements, commentators generally assume that the voting mechanism itself renders plebiscites more democratic than legislative lawmaking. This assumption is mistaken. In this Article, we demonstrate, contrary to conventional wisdom, that all rights are relationally contingent. Our main thesis is that rights afford their holders meaningful protection only against challengers who face higher litigation costs than the rightholder. Contrariwise, challengers who can litigate more cheaply than a rightholder can force the rightholder to forfeit the right and thereby render the right ineffective. Consequently, in the real world, rights avail only against certain challengers but not others. This result is robust and pervasive. This paper analyses H.L.A. Hart’s views on the epistemic character of the law’s assumptions about human behaviour, as articulated in Causation in the Law and Punishment and Responsibility. Hart suggests that the assumptions behind legal doctrines typically combine common sense factual beliefs, moral intuitions, and philosophical theories of earlier ages with sound moral principles, and empirical knowledge. An important task of legal theory is to provide a ‘rational and critical foundation’ for these doctrines.
