The Community Mediation Center Grant Program, funded by the commonwealth and administered by the state’s office of dispute resolution, was established to “promote the broad use of community mediation in all regions of the state” by awarding operating grants to eligible community mediation centers. This annual report describes the progress made in broadening access to community mediation by the grant program under the challenge of reduced state funding in FY 2014. Due to the funding cut, fewer centers were funded in FY 2014 compared to FY 2013, which reduced the quantity of services provided. However, the amount of money per …

Climate change has become an important yet politically divisive topic in recent years. Further complicating the issue are assertions that climate change– related public opinion surveys used by social scientists are biased or otherwise problematic. We conducted a pilot study to explore questions concerning bias and interpretation of climate change surveys. Our study sample was composed of adult residents of Nebraska (n = 115). We augmented our survey findings with cognitive interviews of a subsample of respondents (n = 20). The CMC Grant Program was established in FY 2013 to distribute state operational funding to qualified community mediation centers serving primarily low income citizens. Mediation services are provided through trained volunteers for a wide-range of family, neighborhood and community conflicts referred through courts, public agencies, local businesses, organizations and individuals. Centers deliver training, conduct outreach and education, and actively engage community members on their boards and through local partnerships.

As part of the Community Mediation Center Grant Program, the MA Office of Public Collaboration (MOPC) in FY 2014 awarded four community project grants on youth violence/conflict prevention under a Positive Youth Development (PYD) framework, which includes peer mediation and other youth-focused conflict resolution in schools, communities, and/or families. Four community mediation centers from across Massachusetts were awarded $34,000 to carry-out these projects in partnership with a municipality/municipal entity. An example is the project by Community Dispute Settlement Center (CDSC) in Cambridge, who in partnerships with the Cambridge Police Department and the Department of Human Services has so far trained …

The Parent Mediation Program was established in 2008 as a state-local collaboration to raise awareness of mediation as a viable option for creating workable parenting plans and to mediate parenting issues for never-married, separated, divorced or separating parents across the state. The program aims to annually provide direct educational services to around 250-300 disputing parents, about 170-220 of whom will also receive mediation services.

Differentiating Among International Investment Disputes, Julie A. Maupin

Can investor-state arbitration tribunals, which exercise jurisdiction over limited claims involving discrete parties, render awards that deliver individualized justice while also promoting systemic fairness, predictability and coherence? The answer, I argue, is a qualified yes – provided that the methods employed are tailored to the particular characteristics of each dispute. Using three well-known investment arbitrations as case studies, I illustrate that investor-state disputes vary widely in terms of their socio-legal, territorial, and political impacts. Significant variances along these three dimensions call for a differentiated approach to investor-state dispute resolution. I outline what such an approach might look like and analyze …

In studies of compliance with international law, the focus is usually on the “demand side” – that is, how to increase the pressure on the state to comply. Less attention has been paid, however, to the consequences of the “supply side” – who within the state is responsible for the compliance. This Article is the first study to systematically address the issue of how different actors within the United States government alter national policy in response to the violations of international law. The Article does so by examining cases initiated under the World Trade Organization (WTO) Dispute Settlement Understanding (DSU). …

No Alternative: Resolving Disputes Japanese Style, Eric Feldman

This article critiques the simple black/white categorisation of mainstream versus alternative dispute resolution, and argues that what is needed is a cartography of dispute resolution institutions that maps the full range of approaches and traces their interaction. It sketches the first lines of such a map by describing two examples of conflict resolution in Japan. Neither can justly be called “alternative”, yet neither fits the mould of what might be called mainstream or classical dispute resolution. One, judicial settlement, focuses on process; the other, compensating victims of the Fukushima disaster, engages a specific event. Together, they help to illustrate why …
