Apart from its interesting facts, this case, BOM v BOK [2018] SGCA 83, is significant for its rejection of a “broad” doctrine of unconscionability, the existence of which has been a matter of some debate in English law, and which has been accepted in Australia (see Commercial Bank of Australia Ltd v Amadio (1983) 151 C.L.R. 447; (1983) 46 A.L.R. 402). It also proposes a new test for the doctrine of unconscionability that is narrower than Amadio, based on the requirements inCresswell v Potter [1978] 1 W.L.R. 255. The International Institute for the Unification of Private Law (UNIDROIT) first launched the idea of preparing a code of inter- national trade law. In 1970, the Secretariat of UNIDROIT submitted a note to the newly established United Nations Commission on International Trade Law (UNCITRAL) in justification of such an initiative and indicated some of the salient features of the project. In 1985, when Kim Cotton became Britain’s first commercial surrogate mother, Europe was exposed to the issue of surrogacy for the first time on a large scale. Three years later, in 1988, the famous case of Baby M drew the attention of the American public to surrogacy as well. These two cases implicated fundamental ethical and legal issues regarding domestic surrogacy and triggered a fierce debate about motherhood, child-bearing, and the relationship between procreation, science and commerce. This study (which replaces an earlier article published at the law journal Χρονικά Ιδιωτικού Δικαίου - Chronicles of Private Law, vol. 12 (2012)) examines issues arising from the translation of authoritative legal texts (constituting sources of law in the legal system under consideration), with an emphasis on legislation.
The first part of the article examines instances where authoritative texts of the same legal instrument co-exist in two or several languages, notably in the case of international uniform law instruments, such as the Vienna Convention on the International Sale of Goods (CISG).

This article reviews the status of the CISG in the Israeli legal system. The survey reveals that the attitude of the Israeli courts toward international sales laws has in the past been rather ambivalent. The author argues that while some decisions of the Supreme Court have ignored the international context without a sufficiently clear reason, most of the cases where the convention was actually applied reflect a sympathetic approach toward the idea of a uniform international law of sales. One of the leading contemporary theories of contract law is the relational theory. Notwithstanding its remarkable development since the foundational works of Macaulay and Macneil it would seem reasonably fair to maintain that this body of literature has generally neglected the discussion of legal remedies. El derecho sucesorio es una rama del Derecho que, al menos desde la perspectiva del operador peruano, se considera profundamente vinculada con la tradición y, por ende, casi inmutable. Si bien la influencia de la tradición resulta innegable, al propio tiempo se debe subrayar el profundo cuestionamiento del cual han sido objetos muchas de las teorías y doctrinas que componen el área del derecho de sucesiones. La irrupción de mecanismos contractuales en la praxis profesional y en las construcciones doctrinales relacionadas con el planeamiento sucesorio ha provocado una revolución de la que es necesario rendir un breve recuento.

This paper discusses and critically examines the close interrelations of two of the main defences to liability in damages for torts and breach of contract. After a careful analysis of the various similarities between the doctrines of contributory (or comparative) negligence and mitigation of damages, and the basic difference between the two, the article reaches the conclusion that there is no justification for the ongoing existence of the mitigation doctrine. It should be abolished, and the doctrine of comparative negligence should be adopted across the board in both tort law and contract law.

En el presente artículo se plantean las diferencias entre los mecanismos contractuales cuyos efectos se encuentran vínculados al evento muerte de un invididuo. Con ello se intenta evidenciar, por un lado, que no todo contrato mortis causa es un pacto sucesorio y, por otro lado, que algunos de ellos se erigen como alternativas al testamento. Todo ello importará una reconfiguración de ciertas categorías negociales consideradas institucionales.

Three years have passed since the Supreme Court of Canada rendered its controversial decision in Whiten v. Pilot Insurance Co. In that case, the Court affirmed an almost unprecedented punitive damage award by a jury of one million dollars against an insurance company. More importantly, the Whiten decision appears to be the first attempt by the Supreme Court to construct a comprehensive set of rules and principles in light of which punitive damages cases should be decided in the future.
