Federal And State Laws Regarding Bottled Water – Testimony Before The House Oversight And Government Reform Committee, Domestic Policy Subcommittee, Noah D. Hall
Noah D Hall
Water bottling is big business and getting bigger, growing by about ten percent annually over the past five years. The most important environmental concerns from a legal and regulatory perspective relate to the impact of water extraction to fill the billions of bottles Americans purchase every year. While water bottling has almost no impact on the total national freshwater supply, the majority of bottled water comes from groundwater which has a direct hydrologic connection to springs and other vulnerable surface waters. Thus, even relatively small water withdrawals for bottled water can produce significant impacts at the local scale on other …

Climate Change, Regulatory Fragmentation, And Water Triage, Robin K. Craig

Fresh water is a regulatorily fragmented resource – that is, water is subject to multiple assertions of regulatory authority and to multiple types of use right claims that those authorities regulate. As fresh water supplies become increasingly unequal to task of meeting the multiple demands for both consumptive and in situ use, and as consumptive and in situ uses of water come increasingly into irreconcilable conflict, the various regulatory schemes governing water have also increasingly come into legal conflict. These courtroom battles have revealed many tensions, overlaps, and gaps in the overall governance of water as a natural resource, especially …

WATER LAW: LEGAL TITLES FOR USING THE WATER PUBLIC DOMAIN: This paper studies the ensemble of water resources making up the public domain, distinguishing them from those resources that remain, more or less residually, under private property. On this subject, particular attention is paid to the publification of continental waters made by the «Ley de Aguas, 1985» and to its special temporary regime. Likewise, an analysis of the use regime for water public domain and, especially, of the different titles enabling this regime, is carried out.

In The Heat Of The Law, It's Not Just Steam: Geothermal Resources And The Impact On Thermophile Biodiversity, Donald J. Kochan, Tiffany Grant

Significant research has been conducted into the utilization of geothermal resources as a ‘green’ energy source. However, minimal research has been conducted into geothermal resource utilization and depletion impacts on thermophile biodiversity. Thermophiles are organisms which have adapted over millions of year to extreme temperature and chemical compositions and exist in hot springs and other geothermal resources. Their ability to withstand high temperatures makes them invaluable to scientific and medical research. Current federal and California case law classify geothermal resources as a mineral, not a water resource. Acquisition of rights to develop a geothermal resource owned or reserved by the …
