Public Utilities And Environmental Justice: Electric Restructuring And Deregulation And Low-Income Communities, James W. Moeller

University of the District of Columbia Law Review

Thirty years ago, Potomac Electric Power Company ("PEPCO") sold electric power generated by coal-burning power plants located in the Washington region. Today, PEPCO can sell electric power generated by coal-burning and nuclear power plants located in West Virginia, Pennsylvania,and Illinois. By importing electric power from those states, PEPCO can, in effect, export to those states the environmental impact of coal-burning and nuclear power plants that generate power for affluent PEPCO consumers in the District of Columbia and Maryland.This "outsourcing" of electric power generation was made possible by seismic changes in the structure of the electric utility industry wrought by Congress …

Comment: The Flint Water Crisis: A National Warning Of Failing Infrastructure

Marquette Benefits and Social Welfare Law Review

I look at the Flint, Michigan Water Crisis from a combined perspective that broadens the scope of one of the worst manmade environmental disasters in the history of the United States. The goal of this examination is to bring attention to preventable environmental catastrophes, and put a spotlight on the policies and governing philosophies, which aggregated into neglect to the health of the people of Flint. I briefly analyze Michigan’s emergency manager law’s role in fostering the poor oversight that allowed the crisis to spiral out of control. Case Study: Webster V. Susquehanna Pole Line Company Of Harford County (1910), Alyssa E. Leonhardt

At the turn of the 20th century, the State of Maryland witnessed an increase in the demand for hydroelectricity. Several public utility companies raced to construct a hydroelectric facility on the Susquehanna River, by which they could distribute electricity to Baltimore, Harrisburg, Philadelphia, and Wilmington. This case study examines the use of eminent domain by one such company, the Susquehanna Pole Line Company of Harford County, for the purpose of erecting a continuous transmission line, originating at McCall’s Ferry Dam, the first hydroelectric facility built on the Susquehanna River. Keeping The Lights On During Superstorm Sandy: Climate Change And Adaptation And The Resiliency Benefits Of Distributed Generation, James M. Van Nostrand

Hurricane Sandy (ultimately downgraded to "Superstorm" Sandy by the time it hit the coasts of New York and New Jersey in late October 2012) was the most lethal and destructive hurricane in 2012, resulting in 285 deaths, $68 billion in damages, and 8.5 million utility customers in the eastern United States losing power. Superstorm Sandy provided a wake-up call for electric utilities on the need to adopt a different set of long-term planning tools to improve the resilience of the electric system against anticipated extreme weather events. This Note examines the first amendment right of public utility corporations in light of the recent restrictions imposed on how these corporations communicate with their subscribers and the public in general. Specifically, this Note will focus "on the regulations promulgated by the New York Public Service Commission which prohibited the use of bill inserts on controversial matters of public policy and banned all promotional advertising by public utility corporations."
