The essay investigates the regulatory background of the modern constitutional democracy. Its principal theory is that democracy is, above all, a system of government and as such, is inseparable from the need for an established and efficient public power. The paper contests the collectivist idea that wide social consensus could substitute for public decisions. In doing so, it restates the difference between the organic and representative concepts of democracy. It also shows how the constitutional tradition combines with an instrumental and demystified concept of public power. Government is indispensable but also tamable. In December 1982, at the initiative of Centro de Estudios Públicos, a group of Chilean lawyers met with professor Ernst J. Mestmacker, director of the Max Planck Institute for Private Foreign and International Law of Hamburg. The original subject of the discussion, which included a variety of commercial law issues, was ultimately reduced to topics related to free competition, on which Prof. Mestmacker is one of the most renowned European specialists. El estudio concibe a los partidos como asociaciones que, como otras, requieren normas mínimas de ordenación. Entre las normas que debería establecer la ley, figuran: los requisitos de formación y disolución, sobre la base de que sean objetivos y moderados; la garantía de la democracia interna, mediante la generalización del voto secreto en todas las decisiones de importancia; la protección del derecho de expresión de las minorías y las normas sobre publicidad del funcionamiento y de las finanzas.
