Muslim Prisoner Litigation: An Unsung American Tradition (Introduction), Spearit
Muslim Prisoner Litigation: An Unsung American Tradition (Introduction), Spearit
Book Chapters
For most Americans, “prison jihad” may sound frightening and conjure images of religious militants, bearded, turbaned, and under the spell of foreign radical networks…. While this may be the immediate impression, there is nothing like that happening in American prisons. However, there has been a different type of jihad taking place, one that is real and identifiable. This is not the sensational jihad of headline media; rather, this jihad is uneventful and quiet by comparison and has persisted since the 1960s with hardly any public notice.
Despite little attention and recognition, Muslims in prison occupy a unique spot in the …
Understanding An American Paradox: An Overview Of The Racial Muslim: When Racism Quashes Religious Freedom, Spearit
Articles
In The Racial Muslim: When Racism Quashes Religious Freedom, Sahar Aziz unveils a mechanism that perpetuates the persecution of religion. While the book’s title suggests a problem that engulfs Muslims, it is not a new problem, but instead a recurring theme in American history. Aziz constructs a model that demonstrates how racialization of a religious group imposes racial characteristics on that group, imbuing it with racial stereotypes that effectively treat the group as a racial rather than religious group deserving of religious liberty.
In identifying a racialization process that effectively veils religious discrimination, Aziz’s book points to several important …
The Role Of Activities Of Sheikh Zayniddin And His Mausoleum In The Spiritual Life Of Tashkent, Nematullo Mukhamedov
The Role Of Activities Of Sheikh Zayniddin And His Mausoleum In The Spiritual Life Of Tashkent, Nematullo Mukhamedov
The Light of Islam
In medieval sources, the city of Tashkent was called Shash. Many well-known scholars in the Islamic sciences, such as hadith, jurisprudence, and mysticism, emerged from Shash. Many great scientists from this region are known to the world by the nisbas of Shoshiy and Toshkandiy. Ancient Tashkent was one of the sacred places where great and pious scientists, muhaddis, and righteous people have been buried. Here, the noble bodies of Zangi ata, Sheikh Umar Vali Baghistani, Sheikh Khovand Tahur, Sheikh Zayniddin Kuyi Arifon, and others found eternal rest. In the second half of the XVIII century, Tashkent city was divided into …

The Civil Right To Belong: A Case Study On Immigrant Integration Of Muslim Students In Educational Institutions, Mamoona H. Siddiqui
The Civil Right To Belong: A Case Study On Immigrant Integration Of Muslim Students In Educational Institutions, Mamoona H. Siddiqui
Theses and Dissertations
Constitutional equal protection values serve as social integration policies for new Americans and generations that follow. They promise equal opportunity, fair treatment, protection from unlawful discrimination, and freedom to preserve cultural identities in their new communities. However, in times of national security crises and political polarization, the disjuncture in the way equal protection doctrines have been historically implemented often reflect deep-rooted inequities that impact underrepresented communities. American Muslims are one such community in which members have experienced anti-Muslim and anti-immigrant sentiment particularly after 9/11 and political polarization on immigration and civil rights policies. The study explores the equal protection doctrine …
Natural Law And Universal Human Rights, David F. Forte
Natural Law And Universal Human Rights, David F. Forte
Law Faculty Articles and Essays
Abdullahi An-Na'im has set his life's quest on attempting to find a way that Muslim society can be attuned to the moral commands of the Universal Declaration of Human Rights, a Western creation. At present, the Shari'a and the Declaration are in obvious tension, if not conflict, in areas such as freedom of religion and the rights of women. An-Na'im finds that the Shari 'a is a creation of man derived in history from an interpretation of Islamic sources. Muslims today can legitimately develop their own interpretation relying on the root sources of Islam, but only so long as those …
China, Xinjiang, And The Genocide Convention: The Fragility Of International Law, Lucy Kate Herron
China, Xinjiang, And The Genocide Convention: The Fragility Of International Law, Lucy Kate Herron
Honors Theses
This paper examines China’s actions through the lens of the Genocide Convention to examine the whether the crimes of genocide are being committed against the Uyghur population. It contends that according to the Genocide Convention, China is committing genocide, and particularly through conditions, torture, and rape, against the Uyghur population. However, prosecuting a genocide in court would prove difficult due to China's laws and actions that can be used to defer accusations of genocide and problems with the Genocide Convention in the context of China and the Uyghurs.

9/11 Impacts On Muslims In Prison, Spearit
9/11 Impacts On Muslims In Prison, Spearit
Articles
This essay is part of a volume that reflects on the 20-year anniversary of the attacks of September 11, 2001. The work examines the impacts this event had on the management of Muslims in prison. Soon after the attacks, the culture war against Muslims in the United States began to seep into prisons, where Muslims faced heightened levels of Islamophobia, which cut across several areas of existence: the ability to access religious literature, religious leaders, and paraphernalia, in addition to the federal creation of Communication Management Units. There was also heightened hysteria about the idea of Muslim radicalization in prison, …
Nigeria's Membership In The Organization Of Islamic Cooperation: Origin, Nature, And Impact, Eddy Aitah
Nigeria's Membership In The Organization Of Islamic Cooperation: Origin, Nature, And Impact, Eddy Aitah
FIU Electronic Theses and Dissertations
This thesis explores Nigeria’s membership into the Organization of Islamic Cooperation (OIC), covertly instituted by General Ibrahim Babangida who rose to power as Nigeria’s military head of state in 1985, a strategic move that resulted in socioeconomic benefits which improved the standard of living of the people of Nigeria. Regionally divided, Muslim influence on the north, and Christian to the south. The commingling with other traditional Nigerian religious cultures, sociopolitical strategies, and legislative protocol are contested by these opposing factions on a continuum. Using archival research methods, both textual and multimedia, this work posits that despite the religious controversies and …

Fine Line Between Right And Requirement, Erin Johnson
Fine Line Between Right And Requirement, Erin Johnson
Augsburg Honors Review
Due to the recent influx of Muslims to the United States, many people want districts to set policies concerning whether or not the school should provide accommodations for religious practices, and if so, what steps should be taken. While some districts have no problem accommodating students' religious needs, others argue that accommodating one religion would require equal accommodations for all religions, which has potential to become overwhelming. The following analysis examines the different approaches arguing for and against the school's obligation to accommodate the students' right to practice prayer in public school; I propose that the most practical policy is …

Warrantless Searches Of Electronic Devices At U.S. Borders: Securing The Nation Or Violating Digital Liberty?, Ahad Khilji
Catholic University Journal of Law and Technology
The steady increase of U.S. citizens traveling with smart phones and other electronic devices has been met with the rise of searches and seizures by CBP officers at U.S borders. Although only less than 0.1% of all travelers may actually be subjected to a search while entering the United States, when comparing the statistics between a six month period in 2016 with the same period in 2017, electronic device searches have almost doubled from 8,383 to 14,993. Approximately one million travelers to the U.S. are inspected by the CBP every day. Out of this population, nearly 2,500 electronic devices are …

When Momo was only nine years old, he returned home to find his parents and his six sisters and four brothers had been killed in their own home. Sometime after that, he and his uncle left Somalia together to live in Yemen. He stayed in Yemen until he was sixteen, but when things became unsafe there, he moved to Libya. He had hoped to get on a boat in Libya to go somewhere for a new life, but he was thrown in prison instead. He was harassed and told to ask his family to send money so that he could …

The Extraordinary Judicial Rebukes Of Trump's Travel Ban, John M. Greabe
Law Faculty Scholarship
[Excerpt] "President Trump's two executive orders suspending travel to the United States by refugees and foreign nationals from several Muslim-majority countries have been put on hold by a number of lower court federal judges.
Whatever might be said about the merits of these rulings, and regardless of whether they will be upheld in future appeals, they are extraordinary judicial rebukes of a sitting president."

The French Veil Ban: A Transnational Legal Feminist Approach, Sital Kalantry
The French Veil Ban: A Transnational Legal Feminist Approach, Sital Kalantry
University of Baltimore Law Review
After the gruesome terrorist attack that killed eighty-four people in Nice, many beach towns in France began to ban Muslim women from wearing the “burkini” on beaches. The burkini, which was created by an Australian designer, is modest swimwear that covers the body and hair. The Nice attack occurred on the heels of a series of attacks in France. The timing of the French burkini ban suggests it was targeting Muslims due to the anger over the attacks. The argument that burkinis are not hygienic is a fig leaf for other more pernicious justifications. Others argue that religious garb generally …

Language And The Promised Land: Passage And Migration To A Spanish-Language ‘Third Place’, Kenya C. Dworkin Y Mendez
Cultural Encounters, Conflicts, and Resolutions
The Spanish-language anthology Caminos para la paz: Literatura israelí y árabe en castellano (Buenos Aires: Corregidor, 2007) [Paths towards/for Peace: Israeli and Arab literature in Castilian], compiled by Ignacio López-Calvo and Cristián Ricci, offers us a collection of over thirty reflections—some Jewish, others Muslim—about the millennial but also contemporary situation of two literally related and historic peoples in a language—Spanish—that seemingly allows them to inhabit the same, this time uncontested, space. Despite the potentially questionable title of the work, which couches the conflict as that of a nation-state versus a nation and/or two peoples contesting rights to one same land, …
