The purpose of this project is to bring awareness to the silent victims associated with parental incarceration – their children. Throughout this project, the focus will be aimed towards promoting the education of the effects of parental incarceration and the impact it has on their children in a variety of compacities and how those settings influence incarceration amongst children of incarcerated parents. In addition, this paper will discuss parental incarceration in three different lens views: administrative, ethical, and legal. This thesis is a content analysis of HBO’s fourth season of The Wire. After conducting an in-depth analysis of the content in the thirteen episodes of season four, I then assessed the level of accuracy in the show’s portrayal of two major topics discussed throughout the season: Witness protection and police informant harassment. I did so by conducting several interviews with professionals who have several decades of experience working in the criminal justice system. I compared their personal experience with witness protection programs, witness harassment, and police informant harassment with the content presented in The Wire on these topics. …

The purpose of this project-based thesis is to develop an undergraduate pre-law course that teaches legal research and writing (LRW) and to design its respective description, topics, reading materials, sample syllabus document, and a sample lesson plan. The research portion of this thesis will study the pedagogy of LRW and the connection between LRW skills and the students’ success in law school and careers in law. As families and advocates of students of color labeled with dis/abilities face mounting inequities they turn to the courts seeking protection. Unfortunately, even after courts issue written decisions ostensibly designed to protect students labeled dis/abled, these students continue to experience systematic oppression in school. This is due, in part, to the discourse used by the courts when addressing issues affecting students labeled dis/abled and the elitism of the judicial system. This paper analyzes a shifting landscape of intellectual freedom (IF) in and outside Florida for children, adolescents, teens and adults. National ideals stand in tension with local and state developments, as new threats are visible in historical, legal, and technological context. Examples include doctrinal shifts, legislative bills, electronic surveillance and recent attempts to censor books, classroom texts, and reading lists.

Privacy rights for minors in Florida are increasingly unstable. New assertions of parental rights are part of a larger conservative animus. Proponents of IF can identify a lessening of ideals and standards that began after doctrinal fruition in the 1960s …

Professional school counselors are often confronted with a myriad of legal and ethical challenges when working with students and their families. While school counselors are discouraged from becoming involved in child custody matters, many are unable to avoid the process for a variety of reasons. This qualitative phenomenological research inquiry explored professional school counselors' experiences with court involvement in child custody matters and sought to understand how such experiences may have affected how they perceive their role in assisting children and families who are undergoing divorce, separation, or child custody disputes. Adaptive Behavior Malingering In Legal Claims Of Mental Retardation, Renee M. Kadlubek

In 2002, the Supreme Court ruled that it is unconstitutional to put people with mental retardation to death for capital crimes (Atkins v. Virginia, 2002). Justice Scalia dissented, suggesting that mental retardation is a condition easy to feign. The current study examined whether participants provided with the definition of mental retardation and adaptive behavior ("informed malingering group") are any better at malingering having mental retardation than participants not provided with the definitions ("malingering group"). Three groups of participants participated in this study: the control group, the malingering group, and the informed malingering group. All participants completed an intellectual assessment and …
