On March 22-23, 2015, Touro Law Center hosted a Conference on Billy Joel and the Law. Speakers at the conference included judges, lawyers, law professors, and music scholars, who considered ways in which Billy Joel’s work relates to American law, society, and culture. The conference panels addressed a variety of interrelated topics, including: Billy Joel and Legal Doctrine; Billy Joel and the Practice of Law; Billy Joel, Law, and the Performing Arts; and Billy Joel, Law, and Society.In some ways, the conference was a sequel—or rather, the third in a series—following in the path of previous conferences exploring connections between …

Artists often chronicle historical developments through their chosen medium. In the case of Billy Joel, some of his lyrics can be traced to the early sustainability movements as he wrote about the migration of people from the cities and the attendant problems with rapid suburbanization. Described by Tony Bennett as “a poet, a performer, a philosopher and today’s American songbook,” his lyrics address, among other topics, land use, community development, and environmental issues. This essay uses a series of vignettes drawn from Billy Joel’s career to describe his encounters with copyright law. It begins by examining the ownership of the copyright in Joel’s songs. It continues by considering the authorship of Joel’s songs, and it concludes by evaluating certain infringement actions filed against Joel. This Essay observes that Joel’s encounters with copyright law were confusing and frustrating, but also quite typical. The banality of his experiences captures the uncertainty and incoherence of copyright doctrine.
