This study is a thorough documentation of the introduction and development of civil rights legislation in the City of Fayetteville, Arkansas. Specifically, the study details local and state-wide civil rights legislation that offers civil right protections to the Lesbian, Gay, Bisexual and Transsexual (LGBT) community and the discrimination that they face. The state’s progression towards a more LGBT inclusive society began with local municipalities drafting ordinances protecting citizens from discrimination based on sexual orientation and gender identity; this study focuses on Fayetteville’s and the legislative process that followed. Arkansas’S Trust Code And Trust Planning: A Ten-Year Perspective, Lynn Foster

In 2001, the Uniform Law Commission adopted the Uniform Trust Code, which regulates certain aspects of trusts. One impetus for the trust code was the ever-increasing popularity of revocable trusts as part of standard estate planning packages. Another was the fact that few states—including Arkansas—had well-developed common law trust rules, let alone any statutory trust codes. In 2005, the Arkansas legislature enacted a slightly modified version of the Uniform Trust Code (UTC), titled the Arkansas Trust Code (ATC). As a reaction to the Supreme Court’s historic marriage equality decision earlier this summer, many Southern state legislators opposing the trend toward LGBT-protective laws have proposed legislation that would essentially prohibit municipalities from carving out new antidiscrimination protections for the LGBT community. Conservative Senator Bart Hester spearheaded the passing of one of these “anti” antidiscrimination laws in Arkansas, and states like Texas, West Virginia, Michigan, and Oklahoma are not far behind. These “Hester-type laws” are strikingly similar to the Colorado amendment struck down by the Romer v. Evans Court 20 years ago. Both the Colorado amendment and the new wave …
