The state has long attempted to regulate sexual activity by channeling sex into various forms of state-supported intimacy. Although commentators and legal scholars of diverse political perspectives generally believe such regulation is declining, the freedom to engage in diverse sexual activities has not been established as a matter of law. Instead, courts have extended legal protection to consensual sexual acts only to the extent such acts support other state interests, most often marriage and procreation. Although Lawrence v. Texas altered some aspects of that vision, it reinscribed others by suggesting that sexual activity should be protected from state interference only …

Queering Indigenous Legal Studies, Emily Snyder

A handful of scholars have examined sex, gender, and sexuality in relation to Indigenous laws; yet their work is infrequently taken up in the field, and there is a broader need for conversations about what it means to "queer" Indigenous legal studies. In this paper, I centre and examine work that contributes to this queering so as to promote inclusive critical legal education and engagement. I also discuss the implications of not attending to sexuality and develop preliminary propositions for queering Indigenous legal studies.

Who protects those who protect the nation? In the United States, these responsibilities are levied upon the U.S. Congress, which has Constitutional authority to “make rules for the Government and Regulation of the land and naval Forces.” As such, the U.S. military currently has a robust and well-developed judicial system governed by the Uniform Code of Military Justice (UCMJ). Over the past several decades alarmist reports about the supposed dangers of the sexualised nature of much Japanese popular culture have regularly featured in the English-language press. It has been claimed that Japan is 'awash' in all kinds of pornography, including child pornography (Larimer 1999; Fallows 1986: 38) and that insufficient attempts are made by the authorities to properly regulate the expression of sexual matters. There has been a tendency in English and other European-language reporting on Japan to stress the strangeness and otherness of Japanese values, particularly in regard to sexuality. Reports of Japanese immorality go back as far as the sixteenth century when the first Jesuit visitors to the country were appalled by open displays of cross-dressing and male-male sexual relations (Cooper 1965). After the ‘opening’ of Japan in the mid-nineteenth century, Victorian visitors were alternately intrigued and shocked by the government-regulated prostitution that took place in Japan’s many pleasure quarters. The Youth Internet Safety Surveys are indicative of a small subset of minors who have had contact with sexual offenders in person. Internet sex stings serve to target these adults through the use of police deception, but their use has been on the decline. Sexual offenders are a heterogeneous group; laws often mistakenly lump these various members together. This paper discusses different sources that can take responsible action to prevent online predators from reaching minors and the issue of vigilantism against offenders. Our current laws on sexual predators do not reflect the deeper, more prevalent issue of acquaintance rape.

This paper demonstrates that modern authoritative jurists working within the Shi’i tradition have developed their rules respecting sex regulation to serve three primary commitments. The first of these is that there is an intense and near debilitating desire on the part of human beings generally, though mostly men, for a great deal of sex. This desire must be satisfied, but it also must be tightly controlled. This is because of the second commitment, which is that excessive licentiousness is a form of secular distraction from a believer’s central obligation to worship God.
