El Reglamento (CE) nº 1924/2006 del Parlamento Europeo y del Consejo relativo a las declaraciones nutricionales y de propiedades saludables en los alimentos establece reglas armonizadas sobre la utilización de dichas declaraciones. De este modo contribuye a alcanzar un alto nivel de protección de los consumidores. Su objetivo es lograr que las alegaciones que figuren en el etiquetado de los alimentos comercializados en la UE sean claras, precisas y fundamentadas a fin de que los consumidores puedan tomar adecuadamente decisiones disponiendo de una información efectiva.

In using law as a tool to combat the obesity epidemic, legal scholars and policymakers are drawing heavily on the lessons of tobacco control. This Article describes the resulting emergence of "obesity control law" and argues for a radical reorientation of it from a "denormalization" strategy based on the tobacco control experience to a "destigmatization" strategy based on the HIV prevention experience. What began as an effort to encourage medical doctors to screen and treat patients whose weight put them at risk for health problems has transformed into a much broader public health campaign to address the root causes of obesity. A growing number of state, territorial and local health departments are currently exploring new ways to promote healthy eating and physical activity. With the rise of globalization, American legal commentators are increasingly directing their attention at developments abroad. When commentators discuss changes in Africa, Asia, and Latin America, they frequently use the terms "westernization," "westernize," and "westernized." This language elevates the status of the West, framing it as the reference point for understanding changes in other parts of the world. In this essay, I draw from the fields of law, linguistics, and post-colonial studies to illuminate problems with this common practice of discussing changes in terms of westernization. This article develops two arguments. First, at a national level in Bulgaria, the human trafficking framework is inoperable for identifying abuses worthy of consideration. By comparing the Bulgarian criminal law definition of human trafficking with the international law definition, I argue that the national criminal law definition is overly inclusive. This state of the Bulgarian criminal law makes it difficult to undertake a realistic assessment of the problem. In the face of dire forecasts for anthropogenic climate change, climate engineering is increasingly discussed as a possible additional set of responses to reduce climate change’s threat. These proposals have been controversial, in part because they – like climate change itself – pose uncertain risks to the environment and human well-being. Under these challenging circumstances of potential catastrophe and risk-risk trade-off, it is initially unclear to what extent precaution is applicable. My argument in this essay is that although lawyers routinely use and abuse metaphor as propositional language, they mostly neglect the use of metaphor as poetic language. Poetic metaphor openly invites you to view a topic or a target from a new angle by setting it against or alongside a light source; in this way, it prompts second looks and encourages insights. Propositional metaphor, by comparison, appears designed to persuade you to view the target or the topic under discussion as something you already know about because of your experience with the source. The rules of ethics governing the work of lawyers in state and federal appellate courts in Louisiana derive from the Louisiana Rules of Professional Conduct in general, and from select articles and rules in the Louisiana Code of Civil Procedure, the Louisiana Uniform Rules of the Courts of Appeal, the Federal Rules of Appellate Procedure, and the U.S. Fifth Circuit Rules. This article explores some of the ethical issues implicated by the application of these rules to the handling of appeals.

“Poverty law” refers to policy and lawyering strategies to contest inequality. The rise of the federal welfare state shaped the contours of poverty law in the first half of the twentieth century. This combined with the rights revolution at mid-century to mobilize legal services lawyers and courts in the War on Poverty, which was the zenith of the antipoverty movement. The welfare state’s subsequent decline and federal court retrenchment channeled the antipoverty movement in new directions forged by decentralization, privatization, and globalization: moving it downward (from federal to local), outward (from state to market), and beyond (from domestic to global).

Originalism, Balanced Legal Realism And Judicial Selection: A Case Study, Stephen Ware

The "balanced realist" view that judging inevitably involves lawmaking is widely accepted, even among originalists, such as Justice Scalia, Randy Barnett and Steven Calabresi. Yet many lawyers are still reluctant to acknowledge publicly the inevitability of judicial lawmaking. This reluctance is especially common in debates over the Missouri Plan, a method of judicial selection that divides the power to appoint judges between the governor and the bar.
The Missouri Plan is one of three widely-used methods of selecting state court judges. The other two are: (1) direct election of judges by the citizenry, and (2) appointment of judges by democratically …
