Safety First -In Search Of Justice -School & Law Enforcement Agency Partnerships, Michael Anthony Pickett Dec 2012

Safety First -In Search Of Justice -School & Law Enforcement Agency Partnerships, Michael Anthony Pickett

UNLV Theses, Dissertations, Professional Papers, and Capstones

ABSTRACT

Educational problems are many and varied. At-risk students, achievement gaps and poor student outcomes are hot topics that beg for improvement in equity across the board and stand in the way of achieving excellence. These educative, albeit, social justice issues are not new, but rather, are old problems revisited (Kaestle, 1983; Morrison, 2003). Additionally, the issue of violence in schools is also recognized as not only a social justice problem but also a public health problem (Mercy & O'Carroll, 1988) and is perhaps the most pressing societal issue related to children and youth today. "Safe schools are the concern …

Roger Nash Baldwin And The American Civil Liberties Union, Mathias Alfred Jaren Sep 2012

Roger Nash Baldwin And The American Civil Liberties Union, Mathias Alfred Jaren

Mathias Alfred Jaren

The thesis for this essay is that social work, acting for the benefit and welfare of others, can be accomplished effectively by non-lawyers employing an agenda of political and legal interventions. Legal interventions even as uncomplicated as filing an amicus curiae brief for some unknown defendant being prosecuted for an offense against his government can have significant and important long term implications. This thesis is examined in the context of a life devoted to civil liberties - The Life and times of Roger Nash Baldwin.

Reclaiming Equality To Reframe Indigent Defense Reform, Lauren Sudeall Lucas Jul 2012

Reclaiming Equality To Reframe Indigent Defense Reform, Lauren Sudeall Lucas

Lauren Sudeall Lucas

Equal access to resources is fundamental to meaningful legal representation, yet for decades, equality arguments have been ignored in litigating indigent defense reform. At a time when underfunded indigent defense systems across the country are failing to provide indigent defendants with adequate representation, the question of resources is even more critical. Traditionally, advocates seeking indigent defense reform have relied on Sixth Amendment arguments to protect the rights of indigents in this context; however, the Sixth Amendment approach suffers from a number of shortcomings that have made it a poor tool for systemic reform, including its exclusive focus on attorney performance …

Understanding Community Benefits Agreements: Equitable Development, Social Justice And Other Considerations For Developers, Municipalities And Community Organizations, Patricia E. Salkin, Amy Lavine Jul 2012

Understanding Community Benefits Agreements: Equitable Development, Social Justice And Other Considerations For Developers, Municipalities And Community Organizations, Patricia E. Salkin, Amy Lavine

Patricia E. Salkin

The opportunity to develop a Community Benefits Agreement (CBA) typically arises when a developer announces plans to construct a major project, such as a stadium or a theater complex. Local residents and business owners may often welcome these projects, but they may also have legitimate fears, such as: Will the project displace local residents and local businesses, either physically or through gentrification? Will it cause traffic problems and generate noise, pollution, or other nuisances? Will the economic development benefits espoused by the developer actually create jobs that pay a living wage and offer decent benefits for residents in the neighborhood …

Social Networking And Land Use Planning And Regulation: Practical Benefits, Pitfalls And Ethical Considerations, Patricia E. Salkin

Patricia E. Salkin

This article explores how social networking sites have been used or might be used in the land use context. Part I focuses on the use of social networking for land use planning and zoning. It includes a discussion of the pros and cons of the use of social networking sites to present public information and to gather public input and invite general participation in the process, as well as to provide notice to the public of forthcoming government decision-making. This section offers concrete examples of how this technology is currently being used in the land use context. Part II focuses …

Negotiating For Social Justice And The Promise Of Community Benefits Agreements: Case Studies Of Current And Developing Agreements, Patricia E. Salkin, Amy Lavine Jul 2012

Negotiating For Social Justice And The Promise Of Community Benefits Agreements: Case Studies Of Current And Developing Agreements, Patricia E. Salkin, Amy Lavine

Patricia E. Salkin

A community benefits agreement (CBA) is a private contract negotiated between a prospective developer and community representatives. In essence, the CBA specifies the benefits that the developer will provide to the community in exchange for the community's support, or quiet acquiescence, of its proposed development. The promise of community support may be especially useful to a developer seeking government subsidies or timely project approvals. The CBA is a relative newcomer to the toolbox of strategies that communities may utilize to ensure that development occurs consistent with the sometimes more narrow goals and desires of neighborhood residents, as opposed to the …

Engaging With Tradition: Mechanisms, Strategies, And Tactics, Michael Edwards Jul 2012

Engaging With Tradition: Mechanisms, Strategies, And Tactics, Michael Edwards

Center for Gender & Sexuality Law

The relationships between tradition and social justice are complex and contingent, conditioned by many factors including social context, individual attachments and mechanisms of transmission and re-enactment. These relationships may be positive, negative or neutral from the perspective of LGBT concerns, and they may be approached in a variety of different ways according to the goals and circumstances at hand. The Engaging Tradition Project aims to explore these patterns in order to establish when and why tradition forms a barrier to the achievement of gender and sexual justice, and to identify how tradition can be deployed in positive ways by activists …

Advancing Social Justice As Lawyers: And How Social Media Can Be Part Of Your Effort, Chai R. Feldblum

Georgetown Law Faculty Publications and Other Works

Professor Chai Feldblum's theme is how you can be part of advancing social justice as lawyers–-and how the time that people might say you are “wasting” on social media (be it Twitter or FB or whatever you may use) can, in fact, be an essential part of social justice work.

Teaching Social Justice Lawyering: Systematically Including Community Legal Education In Law School Clinics, Margaret Martin Barry, A. Rachel Camp, Margaret E. Johnson, Catherine F. Klein, Lisa V. Martin

All Faculty Scholarship

There is a body of literature on clinical legal theory that urges a focus in clinics beyond the single client to an explicit teaching of social justice lawyering. This Article adds to this emerging body of work by discussing the valuable role community legal education plays as a vehicle for teaching skills and values essential to single client representation and social justice lawyering. The Article examines the theoretical underpinnings of clinical legal education, community organizing and community education and how they influenced the authors’ design and implementation of community legal education within their clinics. It then discusses two projects designed …

Losing My Religion: The Place Of Social Justice In Clinical Legal Education, Praveen Kosuri Apr 2012

Losing My Religion: The Place Of Social Justice In Clinical Legal Education, Praveen Kosuri

All Faculty Scholarship

Many law school clinics presume a “social justice” mission—that is, representation of the indigent and under-represented about poverty law issues—as the only legitimate goal for clinic clients and matters. This article contends that social justice should not be presumed, but rather should be considered an option—among many—to include in a clinic’s pedagogy. If increased experiential learning opportunities for students are a real objective, and clinics are the pinnacle of those opportunities, then broadening the portfolio of clinical offerings to include those that are not focused on social justice should be a valid proposition. The modern clinical legal education movement that …

Incorporating Social Justice Concerns Into The New Law And Development Movement: The Importance Of Insolvency Law, Julia M. Davis Ms. Mar 2012

Incorporating Social Justice Concerns Into The New Law And Development Movement: The Importance Of Insolvency Law, Julia M. Davis Ms.

Julia M Davis Ms.

This paper focuses on insolvency law as an underutilized area for incorporating social justice concerns into legal reform projects in developing countries. Insolvency is an area of law that already plays a large role in legal development projects and is especially suited for incorporating social justice concerns because of its ability to redistribute wealth and safeguard vulnerable interests. In arguing that insolvency law should be better exploited by social justice advocates this paper briefly reviews the history and literature surrounding the “Legal Development Movement” (LDM) and discusses the responsibilities of development agencies to incorporate social justice concerns into economically-focused legal …

The Legal Clinic Is More Than A Sign On The Door: Transforming Law School Education In Revolutionary Egypt, Stephen A. Rosenbaum Jan 2012

The Legal Clinic Is More Than A Sign On The Door: Transforming Law School Education In Revolutionary Egypt, Stephen A. Rosenbaum

Publications

There is little consensus on what the January 25, 2011 Revolution in Egypt stands for, or whether Egyptians are living through the Revolution or in a post-Revolutionary State. Skeptics say that what occurred is the overthrow of an autocratic President, the retention of an Old Guard military and civil service establishment, and the potential for free and fair national elections. They contend, however, that this seminal event in the Arab Spring produced no revolutionary leadership and no clear platform or message. Is there a role for law schools in the revolutionary transformation?

In this article, the author describes the changes …

The 'Justice Deficit' Debate In Eu Private Law: New Directions, Daniela Caruso Jan 2012

The 'Justice Deficit' Debate In Eu Private Law: New Directions, Daniela Caruso

Faculty Scholarship

This essay outlines the ongoing debate on the justice deficit of EU private law – the ‘social justice’ debate – and then points at an underexplored avenue of inquiry that is essential for this debate to stay meaningful and constructive. Future research should aim to calibrate EU private law to the socio-economic asymmetries of the EU market, and to counterbalance the uneven weight of uniform rules, where they appear desirable, with proper compensatory mechanisms.

Do The Right Thing: Understanding The Interest-Convergence Thesis, Stephen M. Feldman Dec 2011

Do The Right Thing: Understanding The Interest-Convergence Thesis, Stephen M. Feldman

Stephen M. Feldman

Professor Derrick Bell was one of the most influential constitutional scholars of the last fifty years. His insights spurred civil rights scholars as well as thinkers in other fields. One of his most important legacies is the interest-convergence thesis, which asserts that, historically, African Americans gained social justice primarily when their interests converged with the interests of the white majority. In a recently published article, Rethinking the Interest-Convergence Thesis, Professor Justin Driver calls this legacy into question. This Essay defends the interest-convergence thesis from Driver’s attack. It argues that the analytical flaws he identifies only exist by dint of his …
