In these brief comments I take issue with the thesis expressed in Konstantin Sonin’s conference review that economic transition is a thing of the past. To the contrary, I argue that it has only just begun and so has the process of rethinking the economic theories and models that have framed the subfield of transition economics. Specifically, I point out that the many surprises economists have encountered when confronted with the actual results of the transition process reveal deeper flaws in the analytical framework that informs their analyses and policy prescriptions. At the root of many contemporary debates over the civil justice or tort system—debates over punitive damages, preemption, and tort reform more broadly—are underlying questions about the justification for the civil jury. The United States is the only country that still uses a jury in civil cases, and most civil jury trials are tort trials. The jury has more power to decide questions of law in tort than in any other area of law, so any serious discussion of tort law must have the civil jury at its center.

The Relationship Between Legal And Extra-Legal Factors: How Judges Come To Make Their Decisions In Domestic Violence Cases, Ioulia Koublitskaia

University of New Orleans Theses and Dissertations

The purpose of this research is to understand how Trial Court Judges in state and city courts make decisions in domestic violence cases. The researcher examined the relationship between legal (e.g., evidence) and extra-legal factors (e.g., preconceived biases and behaviors related to judicial decision-making) using a qualitative research design. A case study of multiple locations in Orleans and Jefferson Parishes was used whereby a purposive sample of 17 current civil, municipal, and criminal court judges were interviewed. Judicial decision-making strategies were studied via face-to-face interviews, courtroom observations, and content analysis of courtroom communications (e.g., speech, written text, interviews, images, etc.). …

In Israel as in other parts of the world, families, parenthood, and relations between parents and children have changed dramatically over the past few decades. So, too, developments in modern medicine have enhanced the ability to separate sexuality from fertility and parenthood. Many researchers feel that the legal system has not kept pace with these changes, and that traditional models of familial relationships no longer provide adequate tools for dealing with them. Promise And Private Law, Nathan B. Oman

This essay was part of a symposium on the thirtieth anniversary of the publication of Charles Fried's Contract as Promise and revisits Fried's theory in light of two developments in the private-law scholarship: the rise of corrective justice and civil-recourse theories. The structural features that motivate these theories-the bilateralism of damages and the private standing of plaintiffs-are both elements of the law of contracts that Contract as Promise sets out to explain. I begin with the issue of bilateralism. Remedies--in particular the defense of expectation damages--occupy much of Fried's attention in Contract as Promise, and he insists that this particular …
