Toward A Theory Of Procedural Justice For Juveniles, Tamar R. Birckhead

Courts and legislatures have long been reluctant to make use of the data, findings, and recommendations generated by other disciplines when determining questions of legal procedure affecting juveniles, particularly when the research has been produced by social scientists. However, given the United States Supreme Court’s recent invocation of developmental psychology in Roper v. Simmons, which invalidated the juvenile death penalty, there is reason to believe that such resistance is waning. In 2005 the Simmons Court found, inter alia, that based on research on adolescent development, juveniles are not as culpable as adults and, therefore, cannot be classified among the “worst …

This article provides an overview of the role gender plays in juvenile justice processing. It reviews national data on girls’ arrest patterns and links those patterns to girls’ underlying needs and trauma histories. The article then focuses on the increase in arrests of girls for domestic assaults and describes the experience of Washoe County, Nevada, where girls were detained disproportionately for domestic battery as a result of a mandatory detention law. The article goes on to describe Nevada’s successful effort to amend that law to increase discretion and mandate family services and the resulting improvements in services to girls experiencing …

This article aims to provide a practical resource not currently available to juvenile attorneys helping Arizona’s children and youth find permanency and support as they grow to adulthood. This article provides a comprehensive review of the history of Arizona juvenile law and available Arizona legal resources along with their usefulness and accessibility for the Arizona juvenile legal practitioner. It also provides assessments of the cost, best applications, overall utility and locations of the various resources around the state. The appendices include outlines of the Arizona case law regarding both delinquent and dependent juveniles.
