“Aspectos Jurídicos Del Delito De Trata De Personas En Colombia: Aportes Desde El Derecho Internacional, Derecho Penal Y Las Organizaciones No Gubernamentales”, Andres Barreto, Beatriz Londoño, Antonio Varon, Andrea Mateus

Andres Barreto

[The paper aims to set the background for the essay Currency and State Power, by Benjamin J. Cohen, to describe its conceptual framework and conclusions, and to subject to a critical appraisal the premise that monetary power is a result of macroeconomic flexibility, which stems from the international standing of a currency.]

Examining The "Csi-Effect" In The Cases Of Circumstantial Evidence And Eyewitness Testimony: Multivariate And Path Analyses, Hon. Donald E. Shelton, Young S. Kim, Gregg Barak Sep 2009

Examining The "Csi-Effect" In The Cases Of Circumstantial Evidence And Eyewitness Testimony: Multivariate And Path Analyses, Hon. Donald E. Shelton, Young S. Kim, Gregg Barak

Hon. Donald E. Shelton

As part of a larger investigation of the changing nature of juror behavior in the context of technology development, this study examined important questions unanswered by previous studies on the “CSI-effect.” In answering such questions, the present study applied multivariate and path analyses for the first time. The results showed that (a) watching CSI dramas had no independent effect on jurors' verdicts, (b) the exposure to CSI dramas did not interact with individual characteristics, (c) different individual characteristics were significantly associated with different types of evidence, and (d) CSI watching had no direct effect on jurors' decisions, and it had …

Gates & Crowley, Patrol Officer’S Tool Box: Mandatory Conflict Resolution Skills For Police Officers, Christopher C. Cooper Aug 2009

Gates & Crowley, Patrol Officer’S Tool Box: Mandatory Conflict Resolution Skills For Police Officers, Christopher C. Cooper

Christopher C. Cooper Dr.

What happened between a Harvard professor and a street cop from Cambridge was a Testosterone laden confrontation fueled by ego of, and misconceptions held by, both men. In the police academy, we spend hours and hours learning how to fire a gun and then have to go back to the gun range on a regular basis, but not one class or even one hour is spent crafting the best way to talk with citizens. A famous criminologist (Muir) in his studies of American police used the phrase “Streetcorner” Politician to describe the uniformed police officer. What comes to mind of …

The Effects Of Devaluation Of The Tenge Upon The Kazakhstan Economy, John Ja Burke Aug 2009

The Effects Of Devaluation Of The Tenge Upon The Kazakhstan Economy, John Ja Burke

John JA Burke

This article examines the probable effect of the February 2009 devaluation of the Tenge on the Kazakhstan economy. Conventional wisdom holds that currency devaluation increases exports, protects domestic production, and preserves foreign exchange currency reserves. While the latter states the obvious, the causal relation between currency devaluation and increased export revenue and increased domestic production, though logically valid, requires the passage of time to measure. In the context of Kazakhstan, the question of devaluation and its effects also must be examined within the “Dutch Disease” model, as Kazakhstan is an oil dependent country. History teaches that devaluing the Tenge is …

Broken U.S. Police Culture And Lack Of Police Temperament Explain The Infamous Gates-Crowley Encounter, Christopher C. Cooper Jul 2009

Broken U.S. Police Culture And Lack Of Police Temperament Explain The Infamous Gates-Crowley Encounter, Christopher C. Cooper

Christopher C. Cooper Dr.

Any knowledgeable cop can tell you that Dr. Gates was moments away from being tasered or shot. And, that but for Henry Louis Gates’ friendship with the president of the U.S., he would have been just another statistic. When a citizen dares to disagree with an officer—he or she goes to jail. Astonishingly, the prosecutor and the judge and the whole criminal justice system accept the officer’s false account of events and probable cause. And, it happens again and again, but perhaps not anymore---maybe now with less frequency because of an encounter between a small-city cop and a renowned university …

Détecter Et Prévenir : De La Digitalisation Des Corps Et De La Docilité Des Normes., Antoinette Rouvroy, Thomas Berns

Antoinette Rouvroy

Interstate Environmental Impact Assessment, Noah D. Hall Jul 2009

Interstate Environmental Impact Assessment, Noah D. Hall

Noah D Hall

This article proposes a new state-based policy – interstate environmental impact assessment – that builds on the National Environmental Policy Act’s Environmental Impact Statement process to address interstate environmental harms. Interstate environmental harms, which occur when decisions or actions in one state produce negative environmental impacts in another state, have challenged American environmental law for over a century. Interstate environmental impact assessment would provide a procedural mechanism for an affected state and its citizens to influence the source state and minimize or prevent interstate environmental harms. The process itself would address the underlying problems of inadequate information, public process bias, …

The Admissibility Of Social Science Evidence In Criminal Cases, Hon. Donald E. Shelton Jul 2009

The Admissibility Of Social Science Evidence In Criminal Cases, Hon. Donald E. Shelton

Hon. Donald E. Shelton

The rapid development of emerging scientific methods, especially the increased understanding of deoxyribonucleic acid ("DNA"), has had, and will undoubtedly continue to have, an almost stunning impact on our justice system, particularly at the trial level. The forensic applications of these new scientific discoveries have been most dramatically seen in the criminal trial court. They have also caused us to re-examine other forms of forensic evidence that have been rather routinely admitted in our courts. Forensic evidence from social scientists is certainly one of those forms. Which of these forms of scientific forensic evidence have sufficient validity to be used …

I Know It's Not My Problem... But It Happened On My Watch, Geoff Sharp Jun 2009

I Know It's Not My Problem... But It Happened On My Watch, Geoff Sharp

Geoff Sharp

It is at some risk that I set out to promote my expertise in the area of what to do when mediation ends in disagreement.

Nevertheless, I dread those times when the smell of napalm hangs in the air as the parties depart the room with their final exchanges of the ‘see you in court’ variety ringing in my ears.

To assist my investigation of what we do as mediators when destination Yes eludes us, I polled a number of experienced commercial mediators. I am indebted to my friends from Bond University in Queensland, Australia and colleagues from the International …

Desert Island Questions For Mediators, Geoff Sharp Jun 2009

Desert Island Questions For Mediators, Geoff Sharp

Geoff Sharp

When I was a wee lad, I drove others nuts by asking questions. They were, I am told, good open ones usually starting ".... but, why?"

As time passed, I grew into a know-it-all teen and forgot about asking questions, more intent on doing the telling. Now at age 40 and in my role as a commercial mediator, I seem to have come full circle and once again appreciate the value of the well-timed, well-constructed question aimed at the essence of a discussion.

So what are my all-time favourites? What questions do I ask that make people sit back in …

Le Corps Statistique, Antoinette Rouvroy, Thomas Berns Jun 2009

Le Corps Statistique, Antoinette Rouvroy, Thomas Berns

Antoinette Rouvroy

In Praise Of Joint Sessions, Geoff Sharp May 2009

In Praise Of Joint Sessions, Geoff Sharp

Geoff Sharp

This paper deals with the increasing trend amongst mediators to do away with a joint session (where the parties meet face-to-face) at mediation in favour of meeting with the parties privately and adopting a shuttle mediation model.

This is an especially topical debate amongst mediators with some advocating that a purely private session or caucus model of mediation where the parties never meet saves time and is what the market now requires. This compares with other mediators resisting the demise of the joint session, saying it is at the heart of what mediators do and of what mediation is.

For …

Russian Energy Strategy And Transit Routes In Eastern Europe, Aleksander Kotlowski May 2009

Russian Energy Strategy And Transit Routes In Eastern Europe, Aleksander Kotlowski

Aleksander Kotlowski

The article considers perceptions of the new Russian energy policy in Eastern Europe with a particular focus on the Polish perspective. It explains the regional reservations to Russo-German cooperation on the Nord Stream Pipeline project. Then, it summarises the view of the Russian-Ukrainian gas disputes. The paper discusses Poland’s energy security policy and conflicting expectations concerning the Yamal-Europe Gas Pipeline. Attempts to develop new energy alliances and a regional energy security policy towards Russia are further presented together with the joint energy projects in Eastern Europe such as Odessa-Brody, Amber Stream, Skanled and Baltic Pipe, as well as Mazeikiu Refinery …
