With the global growth of public concern about environmental issues over the last several decades, environmental legal norms have become increasingly internationalized. This development has been reflected both in the surge of international environmental agreements as well as the growth and increased sophistication of national environmental legal systems around the world. The result is the emergence of a set of legal principles and norms regarding the environment, such that one can arguably describe it as a body of law. After exploring the diverse forces that are contributing to the emergence of what we call “global environmental law,” this Article considers …

The last ten years have been the warmest on record. During 2007, Arctic sea ice dropped to the lowest levels since measurements began in 1979. Valuable natural resources in the Arctic, including gas and oil, are becoming more accessible to exploitation. The Northwest Passage--a highly desirable shipping route connecting Europe and Asia--is increasingly navigable during the summers. These changes have highlighted new and unresolved legal issues as the nations bordering the Arctic vie for control of these new waters and the resources that lie beneath them.

This is a chapter of a recently published book that examines how constitutional law shapes natural resources law in the United States. Following a brief background, part I identifies and discusses the various constitutional law developments affecting the scope of Congress’s power to regulate the use of natural resources. It focuses primarily on the Commerce Clause (in conjunction with the corresponding case study) and the concomitant extrinsic limits on such authority, including principles of federalism and the Tenth Amendment, as well as the diminished Nondelegation doctrine.
