Putting It All Together: Law Schools' Role In Improving Appellate Practice, Stella J. Phillips

University of Arkansas at Little Rock Law Review

Lawyers make four critical mistakes in current appellate practice. First, many appellants' lawyers do not seem to understand that only some orders may be appealed. Second, appellants often lose their appeals because of the issues about which they argue have not been preserved in the lower court for appellate review. Third, many appellants are unsuccessful because they frame their argument without reference to the appropriate standard of review. Finally, the pressure of client’s expectations and filing deadlines often leads lawyers to become careless when preparing their briefs.

Indiana Law Journal

The U.S. News & World Report annual rankings play a key role in ordering the market for legal education, and, by extension, the market for entry level lawyers. This Article explores the impact and evolution of placement and post-graduation data, which are important input variables that comprise twenty percent of the total rankings methodology. In general, we observe clear evidence that law schools are seeking to maximize each placement and post-graduation input variable. During the 1997 to, 2006 time period, law schools in all four tiers posted large average gains in employment rates upon graduation and nine months, which appear …

Law schools have compelling reasons to begin thoroughly reviewing their skills curriculum. Three new publications emphasize that preparing students for practice as competent and ethical lawyers is the central mission of legal education and scrutinize methods for achieving that goal. A new ABA Standard for Accreditation (the "Standard" or "Standard 302"), revised in 2005 to mandate skills education for every law student, is now being applied at law school reaccreditation reviews.

It Takes A Village To Solve The Problems In Legal Education: Every Faculty Member's Role In Academic Support, Melissa J. Marlow

University of Arkansas at Little Rock Law Review

This article suggests a fundamental shift in the way traditional faculty view their role in academic support, from merely assisting with academic support duties to becoming equally responsible with academic support faculty for student achievement. The article explores how legal education arrived at the current division of labor in teaching weaker students. Additionally, it examines why the current situation is not the best plan of action for maximizing student learning. Finally, it touches upon possible solutions that would work toward uniting law school faculty in their common purpose of preparing all students for the rigors of legal practice.

For most law students, there is a moment when, in frustration or exhaustion, they throw up their hands and scream, "There must be a better way." While many of the cases in the casebooks are interesting, learning the law one case at a time seems, at best, inefficient, and at worst, just plain stupid. Wouldn't it be much easier, and better, if law schools used the same pedagogy that is used in many other disciplines: reading assignments, lectures, and exams that test whether students have learned the information set out in those textbooks and lectures?
