This article briefly discusses the various laws passed by the regime of General Musharraf (1999-2008) to relieve the plight of helpless women in Pakistan and analyses the Protection of Women Act, 2006 from a legal, rather than from a political or emotional perspective. It scrutinizes the opinions of leading 'ulama, such as Justice (R) Taqi 'Uthmani, Mufti Muneebur Rahman, Moulana 'Abdul Malik, and Hasan Madani. This paper attempts to answer the question whether the common law doctrine of precedent as practiced in Pakistan is compatible with the traditional Islamic legal system. After a survey of the various articles and books about the judicial system of Islam it concludes that there is little, if any, material about the role of precedent in Islamic law. The paper also examines the judicial system of India under the Moghuls and the East India Company and traces the origins and evolution of the doctrine of precedent in the Indian sub-continent, more particularly in Pakistan. En esta investigación se formulan críticas al Primer Pleno Casatorio de la Corte Suprema del Perú en materia civil donde se demuestra la ausencia de conocimiento del contrato con lesión enorme y de la transacción. Asimismo, esta jurisprudencia aplica la doctrina de los actos propios para desaparecer los derechos de los damnificados por daño a su salud y para proteger a los empresarios ubicados en una posición dominante.

Suicide attacks are a recurrent feature of many conflicts. Whereas warfare heroism and martyrdom are allowed in certain circumstances in times of war, a suicide bomber might be committing at least five crimes according to Islamic law, namely killing civilians, mutilating their bodies, violating the trust of enemy soldiers and civilians, committing suicide, and destroying civilian objects or properties. The author examines such attacks from an Islamic jus in bello perspective.

Marriage is one of the most sacred contract in Islam and not an ordinary contract of sale and purchase. Making wealth requires people to do what they say. In relationships and repeat transactions, reciprocity makes people do what they say, even without contract law. Relationships and repeat transactions, however, preclude competition. Competition involving transactions with strangers invigorates an economy and enables it to flourish. Making strangers do what they say requires them to commit legally. According to the contract principle for economic cooperation, the law should enable people to commit to doing what they say. The purpose of this article is to provide insight into the basics of the Uniform Commercial Code (UCC) and explore its application to sports law. Particular focus is on the sale of goods found in the UCC's Article 2. Whether a buyer and seller closes a deal for the sale of helmets, bats, balls, backboards, sports memorabilia, a new artificial surface for the outdoor field or to fulfill an order for a new set of game jerseys, the UCC applies to the sale if the parties to the sales contract failed to otherwise agree upon the specifics.

ABSTRACT: The Nigerian Government had entered into Memoranda of Understandings (MoUs) with the various major International Oil Companies (IOCs) in the 1990s providing incentives to the companies at a period when the Oil market was experiencing oil price recession. The MoUs, amongst other fiscal terms guaranteed the IOCs a minimum profit per barrel of oil produced and a lower tax rate from the standard tax rate prescribed under the Petroleum Profit Tax Act. However, the Nigerian Government has recently indicated its intent to terminate the MoUs and replace it with a standard tax plan. In the light of these recent …
