"Thou Shalt Not Put A Stumbling Block Before The Blind": The Americans With Disabilities Act And Public Transit For The Disabled, Michael E Lewyn

The Americans with Disabilities Act (ADA) ordered local governments to make bus and train systems more accessible to the disabled. The ADA imposed costly requirements upon local public transit systems but did not give local governments funds with which to satisfy this mandate. By reducing the funds available to transit systems, the ADA has sometimes forced cutbacks in transit service for everyone (including, ironically, the disabled to the extent that disabled people were able to use public transit before the ADA's enactment). Thus, the ADA has occasionally been counterproductive.

The Impact Of Legalized Abortion On Crime, John Donohue, Steven D. Levitt

We offer evidence that legalized abortion has contributed significantly to recent crime reductions. Crime began to fall roughly eighteen years after abortion legalization. The five states that allowed abortion in 1970 experienced declines earlier than the rest of the nation, which legalized in 1973 with Roe v. Wade. States with high abortion rates in the 1970s and 1980s experienced greater crime reductions in the 1990s. In high abortion states, only arrests of those born after abortion legalization fall relative to low abortion states. Legalized abortion appears to account for as much as 50 percent of the recent drop in crime.

Is the family subject to principles of justice? In A Theory of Justice, John Rawls includes the (monogamous) family along with the market and the government as among the "basic institutions of society" to which principles of justice apply. Justice, he famously insists, is primary in politics as truth is in science: the only excuse for tolerating injustice is that no lesser injustice is possible. This is an investigation into the origin of Communist policing in the People’s Republic of China (PRC). Existing literature on the PRC police (baowei, gongan, jingcha) are not in agreement as to the origin of Communist policing. Most sources, particularly western ones, point to the formation of the Ministry of Public Security in November of 1949 as the origination of Communist police. Others, particularly the PRC police historians, have traced the starting date to November of 1931 when the Chinese Soviet government in Shan-Gan-Ning border area established the Political Security Department (zhengzhi baoweiju). The Status Of The Uniform Guidelines On Employee Selection Procedures: Legal Developments And Future Prospects, Andrew Ewoh, James Guseh

This article examines the legal status of the Uniform Guidelines on Employee Selection Procedures from the perspectives of judicial opinions and race-norming provisions of the Civil Rights Act of 1991. Specifically, the analysis provides a discussion of important U.S. Supreme Court’s decisions with special emphasis on their relevance for disparate impact theory. Because the 1991 Civil Rights Act has altered the selection procedures somewhat, the article offers implications of these changes for personnel managers or specialists and recommends modification of the Uniform Guidelines.

Keeping Feminism In Its Place: Sex Segregation And The Domestication Of Female Academics, Nancy Levit

The thesis of Keeping Feminism in Its Place is that women are being "domesticated" in the legal academy. This occurs in two ways, one theoretical and one very practical: denigration of feminism on the theoretical level and sex segregation of men and women on the experiential level intertwine to disadvantage women in academia in complex and subtle ways.
The article examines occupational sex segregation and role differentiation between male and female law professors, demonstrating statistically that in legal academia, women are congregated in lower-ranking, lower-paying, lower-prestige positions. It also traces how segregation by sex persists in substantive course teaching assignments. …
