The Scope Of Attorney Advertising In Illinois, Robert J. Franco, Anne Scheitlin Johnson

Attorneys have long been allowed to advertise their services, with restrictions. With the extension of constitutional protection to commercial free speech, the professions were given access to marketing techniques which were formerly unknown. Once the toehold had been established, it was not long until commercial free speech was extended to attorney advertising.

Defining "Green": Toward Regulation Of Environmental Marketing Claims, Roger D. Wynne

This Note joins a rising chorus calling for government regulation of green marketing claims. It attempts to encourage and add a sense of urgency to a burgeoning regulatory movement by highlighting some of the legal issues that such regulation entails. Part I identifies a gap in the law: the inability of current truth-in-advertising laws to clarify the legality of green marketing claims. Part II urges bridging that gap quickly; it examines the costs of continued nonregulation and describes some of the forms regulation is taking. This article responds to the critics of state bar ethics committees. Indirectly, it raises some questions about the need, or at least the extent of the need, for yet another law-related cottage industry (the for hire legal ethics consultant). It also provides some friendly advice for those well-meaning types in every jurisdiction who are perennially "reforming" or "energizing" their bar associations and demanding for the "membership" a dazzling new array of services. It discusses practical problems that have gone unmentioned in the limited literature, just as it takes issue with many of the assertions that have been made in that …
