The Breath Of The Unfee'd Lawyer: Statutory Fee Limitations And Ineffective Assistance Of Counsel In Capital Litigation, Albert L. Vreeland Ii

This Note argues that fee limitations deprive indigent defendants of their right to effective assistance of counsel. Part I of this Note reviews state court decisions that address Sixth Amendment challenges to fee limitations, yet fail to address the broader concerns about the appointed counsel system. Part II considers the inherent disincentives and burdens fee limitations impose on attorneys and suggests that the limits threaten the indigent accused's right to effective assistance of counsel. A comparison of the fee limitations and the time required to prepare and try a capital case reveals the gross inadequacy of statutory fee provisions. In …

Gatekeepers Of The Profession: An Empirical Profile Of The Nation's Law Professors, Robert J. Borthwich, Jordan Schau

Part I of this Note surveys the existing body of literature on legal education, with a particular emphasis on previous empirical studies concerning law professors. Part II focuses on the increasing number of women in the teaching profession. Part III looks at the nonteaching experience of law teachers, including judicial clerkships, private practice, government experience, and public interest experience. Finally, Part IV examines the influence of "elite schools" in law school hiring and tenure decisions.

Ever since shepherd children stumbled upon the Dead Sea Scrolls, a small group of scholars controlled access to these writings. These scholars painstakingly edited and published so far about half the historic texts. Scholars not numbered among the select few complained of the arrogance implicit in limiting access to the original materials. Now the critics have their chance. In late 1991 the Biblical Archaeology Society published a "facsimile edition" of the previously unpublished scrolls. Professor Robert H. Defense Counsel As Prosecution Witness: A Combined Doctrine To Govern Attorney Disclosure, David B. Merchant

Prosecutors have increasingly used grand juries to compel defense attorneys to disclose client administrative data such as clients' names, fee amounts, or third-party fee payments. A majority of the federal circuit courts protect administrative information only if disclosure would reveal the substance of previous attorney-client conversations. In contrast, a minority of the circuits protect such information when disclosure would incriminate a client in the case at bar. This Comment argues that neither of the current doctrines accomplishes the goals of the attorney-client privilege. It is uncontroverted that a major technological shift in the delivery of legal information is well underway. What will be the effects of these changes on law librarians and, more importantly, what opportunities will the changes create?
