Second Generation State Takeover Legislation: Maryland Takes A New Tack, Michigan Law Review

Michigan Law Review

This Note examines the approach recently adopted by the Maryland legislature in special session one year after the Supreme Court's decision in MITE. Maryland has departed radically from the regulatory approach of first generation statutes; however, this Note argues that the statute has failed to escape the constitutional infirmities of its predecessors. Part I outlines the various mechanisms that regulate acquisition of corporate control: the federal tender offer regulatory mechanism known as the Williams Act, state takeover legislation such as the Illinois statute invalidated in MITE, and the new Maryland statute. Urban Distress, Educational Equity, And Local Governance: State Level Policy Implication Of Proposition 2 1/2 In Massachusetts, Edward P. Morgan

John M. McCormack Graduate School of Policy and Global Studies Publications

This report examines the impact of Proposition 2-1/2 on different types of communities and the implications of this impact for state aid and state-level policies. The effects of 2-1/2, especially first-year effects in public education, are evaluated from the perspective of four general policy objectives or values: equity, efficiency, accountability, and local autonomy. The primary concern of this report is for various considerations of equity and inequality.

A Cry For Reform In Construing Washington Muncipal Corporation Statutes—Chemical Bank V. Washington Public Power Supply System, 99 Wn. 2d 772, 666 P.2d 329 (1983), Richard Shattuck

In Chemical Bank v. Washington Public Power Supply System (WPPSS), the Washington Supreme Court invalidated a participants' agreement among municipal corporations for joint development of nuclear power plants. The supreme court held that the agreement was void and unenforceable against Washington cities, towns, and public utility districts because these municipal corporations had no authority to enter into the participants' agreement. This Note examines Chemical Bank and its application of Washington municipal corporation law. The Note briefly identifies Washington municipal corporation law prior to Chemical Bank and considers how Chemical Bank relates to this prior law. The Note then discusses some …
