This article contains a general theory that explains why pure economic loss ( that is, financial loss not associated with physical harm to the person or property of the plaintiff) is not to be recoverable at times and is recoverable at other times. The theory stresses the importance in the law of reducing contracting costs while still providing incentives to avoid true social costs.

Comment, The Developing Test For State Regulatory Jurisdiction In Indian Country: Application In The Context Of Environmental Law, Stephen Feldman

The extent of state jurisdiction over Indians and Indians lands has created conflicts between the federal, state, and tribal governments since the nation's inception. Congressional responses to this inveterate problem have fluctuated significantly. At times, Congress has favored the assimilation of Indians into the majority society and the destruction of tribal identities, with consequent increases in state jurisdiction. At other times, Congress has favored separatism for Indians and the preservation of tribal cultures and governments. In 1832, the Supreme Court, in the case of Worcester v. Georgia, held that state laws had no effect within Indian reservations. Since Worcester, the …

Article 3 of the Uniform Commercial Code accords valuable privileges both to the holder in due course and to the surety who signs his principal's note. When the holder in due course sues the surety on the note, however, a conflict inevitably arises between these two typically innocent parties. The conflict is most acute when the surety attempts to assert a real defense of his principal against the holder in due course. Suburban integration following the passage of the Federal Fair Housing Law in 1968 presented an unprecedented challenge to those communities. Residential integration was not the desire of the majority of homeowners then and racial discrimination was deeply imbedded in the business of selling and buying homes. Integration was usually presumed to be the interval between the first black family moving into a neighborhood and the last white family leaving. But not for everyone.
