This thesis will examine the limitations in access to abortion and other necessary reproductive healthcare in states that are hostile to abortion rights, as well as discuss the ongoing litigation within those states between pro-choice and pro-life advocates. After analyzing the legal landscape and the different abortion laws within these states, this thesis will focus on the practical consequences of Dobbs on women’s lives, with particular attention to its impact on women of color and poor women in states with the most restrictive laws. Human rights advocates often argue their primary power is that claiming them and deploying human rights rhetoric adds legitimacy and authority to a cause. Yet our understanding of if, how, and why human rights language is used in the political struggle for equality is incomplete. In this thesis I examine the key question of the use of human rights rhetoric and claiming by activists and governmental actors via the struggle for reproductive rights, especially for access to abortion. Cape Wind was the first proposed offshore wind farm in the United States, but it was never built. Proposed in 2001 and canceled in 2017, Cape Wind fought against well-funded opposition groups who used the regulatory and permitting process to create legal battles every step of the way. The Alliance to Protect Nantucket Sound, which was composed largely of members of the 1% who owned ocean property off the coast of Cape Cod which was where the wind farm was proposed, contributed millions of dollars to ensure that Cape Wind was never built. This thesis will primarily examine the sexual assault crisis Native American women face and the jurisdictional issues that influence whether and how tribes prosecute and punish perpetrators. Federal Indian policy and various Supreme Court cases have increasingly undermined tribal sovereignty over the past few centuries, resulting in tribal governments lacking the ability to respond to sexual violence against their members. Native women who experience sexual violence often find themselves entangled in a complex web of jurisdictional issues, resulting in a lack of clarity about which government body has authority. The language of the Fourth Amendment protects citizens from warrantless searches of their tangible places and things. For centuries strict interpretation of this Amendment sufficed to protect against invasions of privacy, but developments in modern technology have rendered the Amendment’s initial scope inadequate. Our private information has moved from desks to remote servers, and police surveillance has become both ubiquitous and infallible. In response to these developments, the Supreme Court has expanded the scope of the Fourth Amendment. This thesis explores this doctrinal evolution. Restitution of Nazi-looted art in the United States is a complicated legal and policy issue. Victims and their heirs seeking restitution of their stolen art frequently encounter inconsistent legal standards at the state, federal, and international levels. Using Lezmond Mitchell’s case as an example, this thesis will explore the ways in which the federal government should redefine tribal sovereignty to expand Native jurisdiction over the death penalty. For centuries, the U.S. has undermined the cultural beliefs and authority of tribal governments by legally and illegally executing Native Americans. Most recently, the Trump administration executed Lezmond Mitchell, completely disregarding the Navajo Nation’s opposition to the death penalty. According to federal law, the government must receive tribal consent to seek out a death sentence against a Native defendant who is accused of committing an intra-tribal crime in Indian country. …

Transgender student protections are at the center of the most recent debate about the scope of Title IX of the Education Amendments of 1972. Although LGBTQ+ rights and protections have greatly expanded under all areas of the law in the last thirty years, transgender student rights have most successfully advanced through the judicial system.
Through a close evaluation of executive, judicial, and legislative responses to this compelling policy issue, the development of transgender student rights is explored. How are Hartford’s Hispanic immigrants and migrants participating politically? What inhibits or promotes their political incorporation? Close to half of Hartford’s total population identifies as Hispanic, with a portion of those individuals being immigrants or migrants to the city. As a community with a significant presence in Hartford, the political incorporation of Hispanic immigrants and migrants is necessary to ensure the adequate representation of all Hartford residents. This thesis investigates the extent of institutional support for Hispanic immigrant and migrant political incorporation in Hartford. Using the Breonna Taylor case as an example, this thesis will investigate the ways that certain practices and policies in America’s criminal justice system have allowed discriminatory policing to flourish. People of color in America disproportionately experience acts of violence from police officers, and more often than not, there is no justice for these victims. The practices and policies that have been put into place to combat racial injustices in America have been ineffective because of the principles that govern our system. The way that America’s criminal justice system operates is inherently discriminatory and the need for reform is urgent.

This project views Title IX through a lens pertaining to transgender rights. It examines the historic adaptation and expansion of Title IX, and how it historically has not expanded to include transgender individuals. Traditional public schools in Connecticut have been pushed out by newer options since the landmark Sheff vs. O’Neill decision, which called for the development of magnet schools. The influx of magnet schools to Connecticut has caused traditional preschools like the Trinity College Community Child Center (TC4) to experience more competition and lose potential enrollees and revenue. This research seeks to outline the current understandings of Gender-Based Violence (GBV) in academic literature and how it contrasts from the ways governmental and non-governmental bodies interpret and address GBV. A little more than a yearlong investigation in Chile, Nepal, Jordan, Spain, and the United States serves as the foundation of the research. The researcher uses the ethnographic method (Draper, 2015) and the interpretive approach (Schwartz-Shea & Yanow, 2012) to interview individuals successfully and to comprehend better how GBV operates within each of the countries. Many countries around the world have suffered from disastrous dictatorships riddled with human rights abuses. This thesis aims to answer the question of what happens after the dictatorship to address these human rights violations and why the responses differ from country to country. Over the last seventy years, the region has been characterized by widespread violence and war as disputes over territory and religious freedom have heightened tensions between the Israelis and Palestinians. Interpretation And Implementation Of Duren V. Missouri (1978) And Batson V. Kentucky (1986) In Five States, John Lawson

The U.S. Supreme Court decisions Duren v. Missouri (1979) and Batson v. Kentucky (1986) address under-representative venire drawing processes and discriminatory peremptory strikes during voir dire, respectively, to combat jury discrimination. In this thesis, I examine state level implementation of these two decisions in five states - Connecticut, Florida, Louisiana, Illinois, and Washington - to evaluate jury discrimination jurisprudence and recommend improvements at jurisprudential and policy levels. While state-level Duren and Batson jurisprudence remains woefully underdeveloped, recent developments such as Washington’s General Rule 37 and Connecticut’s Jury Selection Task Force could initiate a nationwide reform effort.

This thesis examines the extent to which Title IX has fulfilled its original promise of establishing gender equity between men and women in intercollegiate athletics. To evaluate the OCR’s commitment to establishing gender equity in intercollegiate athletics, the evolution of Title IX from 1972-2020 is provided, demonstrating a disconnect between Title IX’s intent in 1972 and how it is interpreted and enforced today by the OCR. The OCR’s Three-Part Test is analyzed by each prong’s ability to establish and measure gender equity, revealing the test’s inconsistency with the core intent of Title IX, as well as the OCR’s nonexistent enforcement …

Since Pakistan’s inception, Gilgit-Baltistan, a sprawling region in Northern Pakistan, has not been granted provincial status due to its colonial association with the disputed region of Kashmir. Gilgit-Baltistan refutes its forceful integration with Kashmir, an unfortunate remnant of British divide-and-rule strategy, and demands provincial recognition and constitutional rights. Pakistan unfairly claims that it awaits the UN-sanctioned plebiscite in Kashmir to determine the region’s status. However, the likelihood of a plebiscite is little to none, since the Indian government officially annexed Indian-held Kashmir in August 2019, breaching the UN resolution on the plebiscite. Our Constitution mandates the president of the United States be elected through the electoral college, a mechanism originally engineered to be a compromise between a popular vote by qualified citizens and a vote by Congress. The electoral college existed without controversy up until the 21st century because it consistently produced a winning candidate which mirrored the popular vote, our contemporary perception of a democratic voting method. The legitimacy of the electoral college in the 21st century, however, has been called into question after two of the last five presidents have failed to win the popular vote. Following the Supreme Court’s 2004 decision in Crawford v. Washington, tensions between the Sixth Amendment Confrontation Clause and evidence-based prosecution of intimate-partner violence increased. In consequence, the Court forged a path of Constitutional jurisprudence which has weakened the power of the Confrontation Clause, reverted to a disguised reliability test reminiscent of Ohio v. Roberts, and diminished the rights of the accused. Simultaneously, these rulings have created a hierarchy where the severity of private, domestic violence is regarded as a lower level of emergency than public violence. Colonialism/capitalism1 continue to create and exploit a dehumanised labour population in the pursuit of profit and power. The current formation of such a population is formed through heterosexist, xenophobic and racist ideologies revealed in the discourses and practises surrounding the (mis)treatment of refugees, as well as sex tourism and human trafficking in Trinidad and Tobago. The legal backbone of these three modern expressions of colonialism/capitalism in Trinidad and Tobago are the Sexual Offenses Act, the Trafficking in Persons Act, and the Immigration Act. For the past fifty years, American drug policy has been manipulated and enforced in a way that made it possible for drug epidemics to occur and has exaggerated their negative consequences on society. The War on Drugs policy initiatives first implemented in the 1970s created a drug law enforcement structure that has criminalized addiction and made it difficult for addicts to receive treatment.
