This research sets out to highlight the life-altering degree to which negative, domineering depictions of Black women has had and continues to have on their livelihood and also to argue that due to their systemic inability to control and craft their own reputation, this should be categorized as a human rights violation and enforced on the grounds of defamation law. The fall of the Soviet Union in combination with the failures of the international community to intervene in the genocides of the former Yugoslavia and Rwanda spurred a new enthusiasm for human rights as a wholly independent movement, termed the human rights wave. This paradigm shift, identified by Stefan-Ludwig Hoffmann, was an embrace of human rights rooted in the redemption of past wrongs. The Unintended Consequences Of The International Women's Movement: Medicalizing Rape In The Democratic Republic Of Congo, Faye N. Forman

The legal advancements made by western feminists from the 1960s continuing today mark a distinct shift for both the women's movement and mainstream radical feminist philosophy. This project examines the unintended consequences of the rise of the international women's movement as American feminists brought the law to bear as the primary instrument for reform to eradicate rape and violence against women. As contemporary political scholars demonstrate, legal remediation further codifies gender inequality and protective tropes that sexualize women's injury. The “Reasonableness” Of Poverty: Progress And Pitfalls In South Africa’S Socio-Economic Jurisprudence, Benajmin Oliver Powers

The Constitutional Court of South Africa is perhaps the strongest institution in the country today. It is one of the few places for people to pursue institutional redress. In light of this, this thesis critically examines the reasonableness standard, the depoliticizing rhetoric around poverty the Court uses, as well as the practical obstacles for individuals or groups pursuing public interest litigation through the judiciary. It has found that for the Court to be more effective institution in light of the failings of other bodies conceived of by the Constitution, a number of the Court’s approaches must be altered slightly. The Rule That Proves The Exception: A Constitutional State Of Emergency In The United States, Benjamin Salvatore Difabbio

A study of states of exception in constitutional law, this project proposes an amendment to the Constitution of the United States, providing for limited derogations of constitutional rights under declarations of emergency. The project begins with an analysis of US Supreme Court case law dealing with limitations of constitutional rights (e.g. suspension of the writ of habeas corpus and the freedoms of speech and press) during periods of crisis, such as war or the threat of war. This discussion demonstrates the perils of precedent in normalizing the exception in the absence of a constitutional state of emergency. The second chapter …
