Externships As A Vehicle For Teaching Access To Justice, Spring Miller

As a relatively new externship instructor, I spend a lot of time thinking about externships – what they mean for our students, what they add to the clinical curriculum and law school curriculum more broadly, and how best to conceptualize and make the most of these courses that constitute one of the most prevalent forms of experiential legal education.

Thanks to the work of experienced externship instructors and scholars, there are now a number of resources and articles exploring externships’ promise in promoting student learning with regard to lawyering skills and professional development. I have relied on many of these …

Externship Assessment Project: An Empirical Study Of Supervisor Evaluations Of Extern Work Performance, Margaret Reuter

Faculty Works

Field supervisors’ evaluations of their student externs are packed with lively stories. They deliver a fly-on-the-wall perspective, giving us color about the work entrusted to our students, the behaviors our students exhibited, and the enjoyment the attorneys reaped. The authors decided the evaluations were so fertile that they should be systematically scrutinized to seek meaningful, reliable insights about the extern experience, especially regarding the variety, complexity, and responsibility levels of their work. We also saw a prime opportunity to assess an externship program and find ways to improve it. Thus, the Externship Assessment Project was born. We deployed qualitative data …

This article explored the risks and rewards of designing and teaching in an externship program, the goals one might have, and the methods one might use. We have argued that it is important to pay attention to the principles of intentional design when developing an externship program. In particular, we have identified and challenged the assumption that skills development must be the predominant goal for externships. This is a common assumption on the part of legal education regulators in our respective home countries, the USA and Australia, as well as in England and Wales. The Practice Value Of Experiential Legal Education: An Examination Of Enrollment Patterns, Course Intensity, And Career Relevance, Margaret E. Reuter, Joanne M. Ingham

How will law schools meet the challenge of expanding their education in lawyering skills as demanded from critics and now required by the ABA? This article examines the details of the experiential coursework (clinic, field placement, and skills courses) of 2,142 attorneys. It reveals that experiential courses have not been comparably pursued or valued by former law students as they headed to careers in different settings and types of law practice. Public interest lawyers took many of these types of courses, at intensive levels, and valued them highly. In marked contrast, corporate lawyers in large firms took far fewer. When …

The Carnegie education masters, legal employers, and the ABA have appealed for more experiential teaching in law schools. The time is now; every school will soon have to provide at least 6 credits of clinic, field placement, and skills courses for each of their students according to the ABA’s most recent amendments to the Standards for Approval of Law Schools. Educating Lawyers, the 2007 Carnegie Foundation study of legal education, challenges law schools to become more intentional about educating students for formation of professional identity. Noting that clergy education has focused more on the formative aspects of professional education than have other professional schools, the study suggests that legal educators could learn a great deal from clergy education about teaching for professional identity formation. Taking that suggestion to heart, the authors undertook an examination of clergy education, with a particular focus on the role of field education in students’ personal and professional formation.
