The federal government currently publishes 195,245 searchable databases online, a number of which include information about private parties that is negative or unflattering in some way. Federal agencies increasingly publish adverse data not just to inform the public or promote transparency, but to pursue regulatory ends ⎯ to change the underlying behavior being reported. Such "regulation by database" has become a preferred method of regulation in recent years, despite scant attention from policymakers, courts, or scholars on its appropriate uses and safeguards.

Law libraries are filed with the rules that govern our society, thoughtful scholars, conscientious lawyers, some hard working students, and some procrastinating students. In the past, this required libraries to collect hardbound volumes and loose leafs. Today, the collection is beginning to give way to research platforms filed with those same, or similar, materials and then some; much of the primary legal documentation is even freely available on the web.

What kinds of health information should be reported to government for civil purposes? Several competing trends encourage efforts to reassess the scope of constitutional protection for health information: the social and commercial value of health information; the amount of data held by third parties, from health care providers to internet servers; critiques of the third party doctrine exception to Fourth Amendment protection; and concerns about the loss of privacy. The Problem Of Appropriations Riders: The Bipartisan Budget Bill Of 2013 As A Case Study, Irene Scharf

This article tells the story of the enactment of the bill containing Section 2013. It also provides context for Congress's widespread practice of inserting substantive provisions into appropriations bills, and argues that this practice is inappropriate and counterproductive. Enacted in haste, at the end of a lengthy and historically contentious legislative session plagued by threats of an unfunded government, Section 203 was slipped into a bill about a wholly different topic - "keeping the government open and functioning" - without input from key legislators or stakeholders. Hence, its difficulties were foreseeable.

Using Data Analytics Tools To Supplement Traditional Research And Analysis In Forecasting Case Outcomes, Mark K. Osbeck

Companies are now developing legal research tools that employ the power of data analytics to aid case forecasting. These tools hold significant promise as a supplement to the traditional element-focused predictive analysis. Instead of having to rely solely on their own experience to balance the results of the traditional element-focused analysis, lawyers may soon be able to rely on software products that mine data about past cases, and then run the data through algorithms to detect patterns. Those patterns can then inform predictions about likely case outcomes, based upon similarities between the facts, the courts, the individual judges, etc.

Governing The Wild: Databases, Algorithms, And Population Models As Biopolitics, Irus Braverman

This essay draws on interviews with conservation biologists to reflect on two interrelated aspects of the in situ – ex situ divide and its increasing integration: database systems and population management models. Specifically, I highlight those databases and software programs used by zoos in ex situ conservation settings, and the parallel, traditionally distinct, in situ databases and risk assessment models. I then explore the evolving technologies that integrate wild-captive databases and population models and, in particular, emerging metapopulation and meta-model approaches to small population management.
