Reflections On The New Individuals With Disabilities Education Improvement Act, Mark Weber

The new Individuals with Disabilities Education Improvement Act leaves the basics of federal special education law intact, but makes important changes along the periphery. Special education is now much more closely aligned with the No Child Left Behind initiative. The new law allocates funds for the education of children not yet found eligible for special education and pushes school districts to provide services to special education-eligible children in religious and other private schools. It changes eligibility determination rules for children with learning disabilities. It alters dispute resolution procedures. Finally, it makes disciplinary procedures somewhat harsher for children with disabilities, while …

Library Reproduction Rights For Preservation And Replacement In The Digital Era: An Author's Perspective On Section 108, Roberta Kwall

Section 108 of the 1976 Copyright Act delineates limitations on exclusive rights pertaining to reproductions by libraries and archives. Subsections (b) and (c) of Section 108 provide guidelines under which libraries enjoy even further wiggle room for reproductions for purposes of preservation and replacement of original works. It is the purpose of this Commentary to establish that these subsections are in need of revision for three reasons. First, they draw an unnecessary distinction between unpublished and published works. Supplying Human Body Parts: A Jewish Law Perspective, Steven Resnicoff

This article explores two related, but distinct, questions: (1) whether, under Jewish law, it is ethical for someone to buy or sell human body parts, and (2) whether, given Jewish law's perspective, it would be appropriate for the United States to adopt a distribution system that would give preference to people who volunteer to be prospective donors. These questions should interest three different kinds of people: (1) those who seek to abide by Jewish law and, therefore, need to know its rules; (2) those who respect Jewish law, who are curious about it, and who might be persuaded by its …

Emancipation Through Secularization: French Feminist Views Of Muslim Women’S Condition In Interwar Algeria, Sara L. Kimble

Cet article examine la condition des musulmanes algériennes telle que vue par des féministes françaises entre les deux guerres mondiales. Une série de colloques nationaux et internationaux dans la région méditerranéenne analysa les limitations imposées sur les filles et les femmes musulmanes par la tradition patriarcale et s'adressa au gouvernement pour demander des réformes. Cet article démontre que ces féministes françaises approuvaient la « mission civilisatrice » de la France et conseillaient des mesures visant la modernisation, « le progrès » et la laïcité en Algérie.
