Seniority And Affirmative Action: The Shadow Of Stotts, Drew S. Days Iii

The purpose of this paper is to discuss why I think the Reagan administration's avowed commitment to helping only "actual victims" of racial discrimination retards rather than advances the cause of civil rights. I make reference in my title to "seniority" and "the shadow of Stotts" because the current administration is relying upon Supreme Court decisions having to do with seniority, particularly its 1984 opinion in Memphis Firefighters v. Stotts, to justify a wholesale attack upon race-conscious remedies, not only in employment but in education and public contracting as well.

Alternative Families: Obtaining Traditional Family Benefits Through Litigation, Legislation And Collective Bargaining, Barbara Cox

Faculty Scholarship

This article will first discuss the constitutional and equitable basis for extending rights to alternative families. Next, it will discuss each major protection and benefit granted to traditional families and then examine the litigation, legislation, and collective bargaining agreements obtaining or attempting to obtain the same benefit for alternative families. This article will end by arguing that equity and justice require an extension of these benefits to alternative families.

Title Vii V. Seniority: The Supreme Court Giveth And The Supreme Court Taketh Away, Berta E. Hernández-Truyol

UF Law Faculty Publications

Congress intended to solve the widespread problem of nonegalitarian hiring practices by enacting title VII of the Civil Rights Act of 1964 (the Act), during the apogee of the civil rights era. The Act represented a national commitment to end discrimination and to promote equality in employment. The enactment of title VII spawned extensive commentary on the effect of facially neutral employment practices that perpetuated pre-Act discrimination. Particular controversy arose concerning the application of seniority rules to blacks in jobs or seniority units from which they previously had been excluded because of their race.

Aids Policies Raise Civil Liberties Concerns, Lawrence O. Gostin

Georgetown Law Faculty Publications and Other Works

Testing for the AIDS virus and segregation of AIDS carriers raise extremely important civil liberties questions in contemporary corrections. The NPP survey revealed 420 cases of fully diagnosed AIDS cases in state prisons across the country. Given the AIDS-toinfection ratio used by the U.S. Centers for Disease Control, there are between 21,000-42,000 prisoners infected with HIV. Up to 30% of these prisoners will probably develop some serious manifestations of AIDS. More importantly, this figure may continue to double every year. Corrections departments have responded to the AIDS crisis in a variety of ways: 90% use the ELISA ...
