Lawyers, Politics, And The "Lawyers' Interest": An Historical Inquiry, James W. Gordon

The assumption that the occupational identification of "lawyer" is the salient feature in evaluating political motivation is interesting, if questionable, according to the Author. Does occupational identity overwhelm other identities? Are politically active lawyers really a homogeneous group? Are they less affected by competing identities associated with wealth, geography, familial and constituency concerns, political ideology, party considerations, or any of the myriad other sources of public and private motivation of behavior? Surely the hypothesis that politically active lawyers behave differently from nonlawyers is worth investigating. An essay on the Virginia bar from 1870 to 1900 rnust begin with a definition of a Virginia attorney-at-law. In 1870 and for the next twenty-five years, a Virginia lawyer was "any person" over the age of twenty-one of "honest demeanor" who had been examined for fitness and licensed to practice law by any two judges of Virginia courts of record. Having been licensed, each attorney must have then "qualified" to practice in each court in which he wished to appear. The subject I have been asked to address, the moral responsibility of-law schools, is perplexing, less because answers to the implicit question are uncertain than because the meaning of the question is unclear. Our ideas about moral responsibility have been formed in reference to individuals. They presuppose the existence of distinctively human characteristics such as understanding and will. What, then, can be meant by the moral responsibility of "law schools," institutions that, just because they are not human, necessarily lack these capacities?

Compensation Formulas For Court Awarded Attorney Fees, Marshall J. Breger

This article will first analyze different approaches to compensation rates in light of various theories of attorney fees. Second, it will review the case law developing the compensation formulas for court awarded fees and will consider the legislative history of statutory fee shifting. Finally, it will explore the meaning of the prevailing market rate formula and will show that courts using such a formula commonly misapply market rate analysis and fail to appreciate the need for a determination of reasonableness.
