Mich. Ruling Widens Sentencing Protections For Young Adults, Kimberly A. Thomas

On July 28, the Michigan Supreme Court held that the mandatory imposition of a life-without-parole sentence on an 18-year-old violated the state constitution.

This decision expands the protections provided for young defendants by the U.S. Supreme Court in Miller v. Alabama and builds on a nascent trend that provides additional constitutional and statutory protections for young people over 17 years old who are charged with serious offenses.

In the 1980s and 1990s, driven to a moral panic by a sudden escalation in juvenile homicide rates, Michigan lawmakers enacted tougher laws with the intention of cracking down on all juvenile crime. That was the era of the “superpredator” (a term that has recently resurfaced in the presidential contest), a term coined by John Dilulio ,a Princeton professor who later became the Director of Faith Based Initiatives in George W. Bush’s administration, and was spread far and wide by a number of self-serving reform advocates who predicted an onslaught of psychopathic juvenile predators.

The recent Baby Jessica case and others like it have renewed the nature versus nurture debate in family law. Baby Jessica's biological parents, the Schmidts, sought to obtain permanent custody of their daughter after giving her up for adoption to the DeBoer family. Their argument was one that found its basis in biology and the idea of a traditional family.
