European legislation for occupational safety and health (OSH) is based on the prevention of accidents and ill health. Apart from European directives, all Member States have national laws and strategies and expect enterprises to implement this preventative ethos, and thereby ensure adequate performance in OSH. Labour Inspectorates monitor and if necessary enforce these laws by deploying individual Labour Inspectors to chosen enterprises. If workplace safety and health conditions are found to be substandard, Labour Inspectors are expected to improve the situation using persuasion and, if necessary, their authority to compel enterprises through specific sanction powers. On the 9th May 2013 the Supreme Court in McGowan and Ors v The Labour Court and Ors found Registered Employment Agreements to be incompatible with the Constitution. Registered Employment Agreements (REA) are provided for in Part III of the Industrial Relations Act 1946. Collective bargaining has traditionally been the method for employees and employers to negotiate terms of employment within the construction industry. These agreements would then be registered with the Labour Court and they would have legal effect. The Irish State in recent years has suffered huge financial losses in the public works sector, which has now pushed the Irish Government to explore new ways of controlling cost. This background lead to the introduction of the Capital Works Management Framework in 2007 which aimed to support the certainty of outcome in terms of cost and quality, as well as improved risk management, through the implementation of fixed price contracts. The strengthening of spatial database infrastructures, further promoted by the INSPIRE Directive adopted in 2007, has led to an increased use of spatial data in planning and decision-making. Given that land-use plans are intrinsically spatial, such evidence and approaches can significantly benefit plan-making. A spatial framework could especially support the specific Strategic Environmental Assessment (SEA) aspects of the plan-making process. Spatial tools such as Geographic Information Systems (GIS) are particularly well-placed to support the environmental integration sought in SEA by providing evidence through the spatial assessment of multiple environmental datasets.
