Reflections On Motion Picture Evidence, Brian L. Frye

Courts have long admitted motion pictures as evidence. But until recently, making motion pictures was expensive and cumbersome. Today, making motion pictures is cheap and easy. And as a result, people make so many of them. As Cocteau predicted, the democratization of motion pictures has enabled people to create new forms of motion picture art. But it has also enabled people to create new forms of motion picture evidence. This article offers a brief history of motion picture evidence in the United States, and reflects on the use of motion picture evidence by the Supreme Court.

This article reports on the second stage of a national study of how the effects of alcohol and other drugs are treated by criminal laws and the criminal justice system. Based on a mixed methods analysis of more than 300 appellate court decisions from all Australian jurisdictions handed down in the period 2010-2014, we identify the multiple points at which legal significance is attached to evidence that the accused, the victim or a witness was 'intoxicated' at the time of the alleged commission of a criminal offence. Fulling Mills In Medieval Europe: Comparing The Manuscript And Archaeological Evidence, Adam Robert Lucas

This paper provides a brief overview of some of the current knowledge concerning medieval fulling mills, drawing on archaelogical finds and manuscript evidence from medieval and early modern England, Wales, France, Germany and other parts of Continental Europe. Illustrations of fulling mills from 1500s and 1600s are compared with medieval accounts of their construction, main tenance and repair. This evidence suggests that fulling mills were simply conventional watermills with the same waterfeed and drive mechanisms as grain mills, but which substituted right-angled gearing and millstones with cam-operated trip-hammers, walk stocks or stamps and fulling troughs. This essay examines hip hop music as a form of legal criticism. It focuses on the music as critical resistance and “new terrain” for understanding the law, and more specifically, focuses on what prisons mean to Muslim hip hop artists. Losing friends, family, and loved ones to the proverbial belly of the beast has inspired criticism of criminal justice from the earliest days of hip hop culture. In the music, prisons are known by a host of names like “pen,” “bing,” and “clink,” terms that are invoked throughout the lyrics. The debate over climate change is relatively young while nuclear power and pesticides have been heated topics since the 1960s, and fluoridation since the 1950s. So what is it about these scientific controversies that makes them seem to go on forever?
Some campaigners despair, assuming that those on the other side simply refuse to acknowledge the overwhelming evidence: “They must be ignorant. Or devious – they’re lying. Or they’re getting paid.”
Ignorance or psychological resistance might be relevant in some cases, but there are better explanations for why controversies persist.

Seeking Truth On The Other Side Of The Wall: Greenleaf’S Evangelists Meet The Federal Rules, Naturalism, And Judas, Nancy J. Kippenhan

An inquiry that seeks truth by accepting only natural answers excludes the possibility of the sacred or supernatural, building a wall that forecloses a complete exploration for the truth it seeks. Without analysis, critics dismiss sources presenting supernatural explanations, and those who believe sacred works have no factual foundation accept without investigation any popular theory that appears attractive. The rules of evidence expressly seek truth, wherever it lies. Noted legal scholar Simon Greenleaf used evidentiary principles to demonstrate the factual credibility of the Gospels in his Testimony of the Evangelists. In a democratic society, law is an important means to express, manipulate, and enforce moral codes. Demonstrating empirically that law can achieve moral goals is difficult. Nevertheless, public interest groups spend considerable energy and resources to change the law with the goal of changing not only morally-laden behaviors, but also morally-laden cognitions and emotions. Additionally, even when there is little reason to believe that a change in law will lead to changes in behavior or attitudes, groups see the law as a form of moral capital that they wish to own, to make a statement about society. Who Knew? Admissibility Of Subsequent Remedial Measures When Defendants Are Without Knowledge Of The Injuries, Mark G. Boyko, Ryan G. Vacca

Federal Rule of Evidence 407 prohibits the introduction of subsequent remedial measures for the purposes of demonstrating negligence, culpable conduct, or product defect. But the rule breaks down, in application and purpose, when a defendant undertakes the new safety measure after the plaintiff's injury, but before the defendant had knowledge of the loss. Such a situation is not uncommon. Would-be defendants frequently improve their products and product safety for a variety of reasons. Toxic exposure cases, where exposure often predates diagnosis of the injury by a decade or more, represent a prime example of cases where defendants are likely to …
