Many South Korean law firms saw the liberalization of the South Korean legal market, with an estimated size of approximately $3 billion (as of 2010), as a major risk factor given the negative experience of Germany and France, two markets that were dominated by foreign law firms following liberalization of their legal services markets. Cognizant of this, South Korean policymakers strategically structured the liberalization of South Korea’s legal market in a way that would maximize the benefits and mitigate the risks to local law firms. This article identifies some of the most important U.S. and international developments in transnational legal practice and provides citations for further research. The article begins by briefly reviewing the impact of the recession on legal services. The second section focuses on international developments. It identifies some of the ongoing efforts to implement the 2007 U.K. Legal Services Act, including the issuance of the influential Hunt and Smedley reports. It also provides information about law reform initiatives in France, Scotland and Korea. The increasingly international reach of law owes part of its momentum to individual lawyers and law firms that function as carriers of ideas, processes and policies. U.S. lawyers are important participants in this expanding influence of law, as they educate, train and deploy individuals educated and licensed in the U.S. and abroad. This article examines the ways in which law firms internationalize, and considers the regulatory environment governing crucial interactions between U.S. and foreign-educated lawyers.
