For proponents of institutional economics, laws are one of the humanly devised constraints that structure human interactions. Like other formal and informal constraints, they define the incentive structure of societies and economies. In Freedom Bound, Christopher Tomlins subtly shifts the emphasis, suggesting that we think of laws not simply as constraints but as a “technology” that provides “. . . a means by which designs, structures, institutions might be imagined, created, implemented, andimplanted” (p. 506). Viewed as technology, legal thought is both a tool enabling action and a constraint, channeling that action in specific directions.

Over the years, military planning has attracted a lot of attention by researchers with the aim of providing automated planning support tools. There have been some successes (e.g., DART system which was used for movement during Gulf war) however, to-date, planning still remains a very human activity with little or no automated support tools. Why? A possible reason for this predicament is that researchers have not fully conceptualized the problem. Two arbitrators' viewpoints of construction claims development are provided in the hope that the information will be useful to those needing to resolve construction claims by arbitration. It also may help to reduce the volume of costly and unnecessary documentation. Because of arbitration's relative formality, attorneys representing construction contractors and owners tend to prepare their cases in the same way as they would for litigation. This leads to potential information overkill, which threatens the arbitration panel's ability to easily sort through and understand the issues in its quest for a fair and equitable decision.

Cold War thinking continues to guide United States' policy in the Post-Cold War environment. Continuing to pursue policies forged during the Cold War will not be adequate to address proliferation for two reasons. First, Cold War policies do not reflect changes in the world in respect to other major or regional powers. Second, current policies overlook potential long-term counterproductive consequences. Adopting an overarching national policy on arms control will require understanding different world views of the United States, other major powers, and regional powers.
