Enhancing Public Engagement On Offshore Wind Energy Using Genius Loci: A Case Study From A Lake Michigan Coastal Community, Erik Edward Nordman, Daniel O'Keefe, Erika Arndt

We describe a novel approach to public engagement on offshore wind energy based on genius loci (“spirit of a place”). North America lacks offshore wind farms but they could be viable in the Great Lakes. Cultural ties between coastal Michigan, USA and the Netherlands offered opportunities to learn from the Dutch offshore wind experience. Residents from a Lake Michigan coastal community with Dutch heritage videoconferenced with a Dutch tourism specialist regarding the Egmond aan Zee offshore wind farm. Important differences and similarities between the regions emerged, including the clustering of technological expertise, tourism effects, and perspectives on working seascapes. Michigan …

Pregnancy Denied, Pregnancy Rejected In Stephanie Daley, Susan Ayres, Prema Manjunath

This article offers a reading of Hilary Brougher’s film Stephanie Daley (2006), in which a teen is accused of murdering her newborn (neonaticide). Brougher depicts a “phenomenology of unwanted pregnancy” and an example of therapeutic jurisprudence. Part One examines Brougher’s treatment of the “shadow side of pregnancy,” and highlights barriers to the empathetic treatment of neonaticide. Part Two emphasizes the process of therapeutic jurisprudence as experienced by the two main characters. Brougher’s film provides a social narrative and phenomenology that may influence laws and legal responses and enlarge social understanding of unwanted pregnancy.

Writing Better Jury Instructions: Antitrust As An Example, Joshua P. Davis, Shannon Wheatman, Cristen Stephansky

Understanding the law is difficult. Getting juries to understand the law is more difficult. Yet we provide evidence that it can be done, even in complex areas such as antitrust. This Article tests whether jury instructions can be written in a way that maintains fidelity to the law—indeed, improves on fidelity to the law compared to standard jury instructions—while also permitting jurors to understand the relevant legal standards. But it goes further than that. It proposes making empirical testing an integral part of drafting model jury instructions. The 1971 Environmental Rights Amendment to the Pennsylvania Constitution at Article I, Section 27 created individual rights to clean air, pure water, and other environmental features as well as a public trust in the Commonwealth’s public natural resources. Judicial interpretation significantly narrowed Section 27’s reach until the Pennsylvania Supreme Court’s Robinson Township decision in 2013 reinvigorated the Amendment. In the aftermath of Robinson Township, government officials and courts will need guidelines for how to comply with Section 27 in making and reviewing government actions and decisions. This article develops a set of concrete, practical principles for applying Section 27. It …

Human Trafficking explores the legal, moral, and political attempts to contain sex and labor trafficking. The authors bring unique perspectives to these topics. Professor Page, an African-American woman all too familiar with the vestiges of slavery, has written and lectured internationally on trafficking. Professor Piatt, a Hispanic law professor and former law school dean, brings his international experience as an educator, author, and advocate regarding immigration and human rights matters to bear.
