San Diego Law Review

This Comment discusses three major copyright questions raised by non-fungible tokens (NFTs) creation and distribution in the digital art world. First, how does employing AI in the creation of generative and derivative digital art and NFTs affect the copyright requirements of authorship? Second, who is the rightful owner of an NFT image pre- and post-purchase? Finally, how does the first sale doctrine apply to NFT image purchases and are those protections enough to resolve future copyright-specific NFT claims? In Part I, an introductory example is laid out to showcase the complex issues generative and derivative digital art and NFT images …

Kelemahan Undang-Undang Hak Cipta Dalam Melindungi Ekspresi Budaya Tradisional, Amalia Karunia Putri Dec 2022

Kelemahan Undang-Undang Hak Cipta Dalam Melindungi Ekspresi Budaya Tradisional, Amalia Karunia Putri

"Dharmasisya” Jurnal Program Magister Hukum FHUI

The Indonesian perspective on materiality is concrete that is communal. Laws and regulations relating to the protection of Traditional Knowledge and Traditional Cultural Expressions in Indonesia have not been able to properly support the development of Traditional Knowledge and Traditional Cultural Expressions. The number of rules regarding inventory scattered in several laws has apparently not been able to connect with one another to make Traditional Knowledge and Traditional Cultural Expressions develop. Therefore, apart from protection efforts, it is also important to use it in the framework of protecting traditional knowledge itself. Because Traditional Cultural Expressions are one of the identities …

Individual or personal freedom is a basic and important requirement of the human being in various peoples and throughout the ages. The person has taken a long march of struggle and struggle to defend and protect it, and this has been demonstrated in the affirmation of personal freedom and the rights associated with it in various legislations around the world.

At the forefront of those rights is the human right to prohibit the image and not to take it, publish it or use it without its consent.

The risks to this right have increased with the scientific and technological progress …

Human Rights In The Era Of Artificial Intelligence “Figures, Opinions And Solutions”, Dr. Heidi Issa Hassan Nov 2022

Human Rights In The Era Of Artificial Intelligence “Figures, Opinions And Solutions”, Dr. Heidi Issa Hassan

مجلة جامعة الإمارات للبحوث القانونية UAEU LAW JOURNAL

Technology has cast its shadow on us in most aspects of our lives and nothing has escaped its grip even human intelligence. Human intelligence now has a major rival known as "artificial intelligence" (AI). The main question is can machines think like humans?!

Since AI involves, in part, the dispensation with humans, then it is a matter that affects human rights, regardless of the manifestations, consequences or even scope of this dispensation.

Accordingly, this study has several problems to tackle: 1) the absence of adequate binding national and international provisions governing AI, 2) AI systems involve changing the way businesses …

The Legislative Development Regulating Medically Assisted Reproductive Technology In Algerian Law: A Comparative Analytical Study, Dr. Muorad Seghir, Dr. Dellal Yazid

UAEU Law Journal

Algerian legislation has included provisions related to what is known as artificial insemination under Article 45 of the Family Code, after its amendment, without defining it, as well as deficiency in controlling its conditions. However, the new health law 2018 remedied the matter, by means of a new, more accurate and meaningful designation (medical assistance for reproduction), based on most modern legislation in the medical field, such as French law, UAE law and others. As well as explaining the terms and conditions for performing this type of reproductive method. However, this dual regulation of the Medicaid Reproduction Mechanism between the …

Is Title Vii A “Civility Code” Only For Union Activities?, L. Camille Hebert Oct 2022

Is Title Vii A “Civility Code” Only For Union Activities?, L. Camille Hebert

University of Arkansas at Little Rock Law Review

Changes to labor law by the National Labor Relations Board are nothing new; changes in Presidential administrations often result in changes to the law, based on differences in philosophy by new majorities of the Board toward the proper interpretation of the National Labor Relations Act. But in2020, the Board made a fundamental change to long-standing interpretations of the Act’s protections for union and other concerted activities, not based on the Act itself, but based on what it said were the mandates of the anti-discrimination laws for employers to prevent harassment and discrimination. The Board contended that the former context-driven standards …

Rage Against The Machine: Reducing Robocall Abuse To Protect At-Risk Consumers, Nicole Egan May 2022

Rage Against The Machine: Reducing Robocall Abuse To Protect At-Risk Consumers, Nicole Egan

University of Massachusetts Law Review

For most people, robocalls are nothing more than an annoying side-effect of owning a cell phone today. But a successful robocall scheme is still capable of wreaking financial and psychological havoc on its victims. Senior citizens and cognitively impaired individuals are often targeted by fraudulent phone calls or texts because they may have trouble understanding how to identify and protect themselves from robocall abuse. This Note proposes a collaborative solution to this problem by calling on the judiciary and legislatures to minimize the amount of robocalls received by American telephone consumers. By adopting a broader understanding of the law and …

The Migrant Protection Protocols: Two Administrations, One Outcome, Alexandria Doty

Immigration and Human Rights Law Review

Immigrants have long seen the southern border of the United States as the last stop before they are able to enter the land of the free. The Department of Homeland Security, however, strives to make the southern border as inhospitable as possible to those hoping to cross. The Migrant Protect Protocols is the latest attempt from Washington to block access to the United States to immigrants who are detained by forcibly returning them to Mexico to await their deportation proceedings. While Americans have read stories of families being torn apart at the border or listened to interviews of politicians promising …

Territorial Exceptionalism And The Americanwelfare State, Andrew Hammond Jun 2021

Territorial Exceptionalism And The Americanwelfare State, Andrew Hammond

Michigan Law Review

Federal law excludes millions of American citizens from crucial public benefits simply because they live in the United States territories. If the Social Security Administration determines a low-income individual has a disability, that person can move to another state and continue to receive benefits. But if that person moves to, say, Guam or the U.S. Virgin Islands, that person loses their right to federal aid. Similarly with SNAP (food stamps), federal spending rises with increased demand—whether because of a recession, a pandemic, or a climate disaster. But unlike the rest of the United States, Puerto Rico, the Northern Mariana Islands, …

The Role Of Sunnah In The Protection Of The Environment Mar 2021

The Role Of Sunnah In The Protection Of The Environment

UAEU Law Journal

Protecting the environment from pollution is probably a major international problem. Islam preceded all man-made legislations in protecting the environment. The legislations of Islam were adequate enough to protect the environment in a way that guarantees the best use of it. This paper consists of five parts. In the first part, the concept of environment was defined from a linguistic, geographical, and general sense. The concept of environment in Islam and the role of man in protecting it were also explained in the first part. The second part of the paper was devoted to the role of the Sunnah in …

Protection Of Pharmaceutical Products And The Second Medical Indications In Comparative Legislation And International Conventions, Kameran Hossen Al-Salihi

UAEU Law Journal

During the past decades, many changes have occurred in the legal system of patents, protection of pharmaceutical products and methods of manufacturing pharmaceutical products. The World Trade Organization (WTO) and the European Patent Convention (EPC), in 1977, has extended the protection of pharmaceutical products and the method of their manufacturing. The TRIPS Agreement which came into force in 1995, committed its Members to provide protection to all their pharmaceutical products regardless of the field of technology. Thus, pharmaceutical products and methods of manufacturing are now covered by this International Protection Act as well as by their National Legislations. However, this …

The International Legal System For The Protection Of The United Nations Peacekeeping Forces

UAEU Law Journal

In this research, we deal with International Legal System for protecting UN Peace Keeping Forces, based on the important and increasing role, which such forces practice in international relationships.

By this study, I find that international protection system has not achieved its intended purpose. It is stained by inability and ambiguity. Such is a natural result of the fact that such system has been formulated as reaction to the assaults, which such forces were subject to recently.

The rules and immunity of UN Peace Keeping Forces remained dispersed within international legal texts.

No clear criterion has been formulated to apply …

Extent Of The Sufficiency Of The Legal Guarantees For The Protection Of The Insured Against The Condition Of The Forfeiture Of The Right For The Warrant Prescribed In The Insurance Policy Under The Jordanian Legislation; A Comparative Study, Nabeel Al Shatanawi, Jamal Talal Al-Naimi

UAEU Law Journal

Due to the lack of legislative provision in the Jordanian Civil Law about the penalty stipulated as a result of the breach in the commitment to notify about the occurrence of the risk, it has been a well-established practice within the Insurance company not to be sufficed by the general rules of penalties. Thus, this paragraph was added to the insurance policy, whether or not related to a legal commitment or through agreement, a penalty concerning the violation if notifying about the risk occurrence, that the right of the insured in the insurance amount is forfeited, in spite of the …

Developing International Guidelines For Protecting Schools And Universities From Military Use During Armed Conflict, Steven Haines Feb 2021

Developing International Guidelines For Protecting Schools And Universities From Military Use During Armed Conflict, Steven Haines

International Law Studies

One consequence of armed conflict, especially that of a non-international character, is serious damage done to vital societal infrastructure. Education–schools and universities–can be severely disrupted, even subject to attack. Targeting of schools may not invariably be unlawful if educational facilities are being put to military use. Such use may itself not be unlawful but it can result in schools being transformed from civilian objects into military objectives–and subject, therefore, to lawful targeting. This was a problem highlighted by humanitarian NGOs a decade ago and led to the formation, by both NGOs and United Nations agencies, of the Global Coalition to …

My Body Is Note My Choice Anymore? How Conscience Protections For Doctors Violate An Individual’S Right To Use Contraceptives And The Establishment Clause, Wanying Yang

American University Journal of Gender, Social Policy & the Law

Introduction

After a month of waiting, Evann finally met her gynecologist for a consultation on her first intrauterine device (IUD). However, before Evann told the gynecologist her request and symptoms, the gynecologist emphasized she was in a Catholic hospital and that they only prescribe oral contraceptives to patients with heavy cramping. The gynecologist then passed Evann an unofficial paper with an IUD provider’s number and expressed sorrow regarding Evann’s decision to use contraceptives. Evann walked out of the hospital without any information on the IUD, but instead with frustration and shame.

Litigating For The Homeland: An Indian Treaty Framework To Climate Litigation In The Wake Of Juliana, Evan Neustater Sep 2020

Litigating For The Homeland: An Indian Treaty Framework To Climate Litigation In The Wake Of Juliana, Evan Neustater

Michigan Journal of Environmental & Administrative Law

Climate change is an increasingly pressing issue on the world stage. The federal government, however, has largely declined to address any problems stemming from the effects of climate change, and litigation attempting to force the federal government to take action, as highlighted by Juliana v. United States, has largely failed. This Note presents the case for a class of plaintiffs more likely to succeed than youth plaintiffs in Juliana—federally recognized Indian tribes. Treaties between the United States and Indian nations are independent substantive sources of law that create enforceable obligations on the federal government. The United States maintains a …

Institutional Framework For Open Space Conservation, Janice Griffith Aug 2020

Institutional Framework For Open Space Conservation, Janice Griffith

Journal of Comparative Urban Law and Policy

Finding an effective approach to conserve large-scale, multipurpose open spaces through a coordinated network across jurisdictional boundary lines has proved elusive. Because open space infrastructure serves so many functions ranging from recreational trails to ecological systems protection, decision makers have often treated open space as a subpart of another activity and overlooked its importance. After discussing the benefits of open space conservation, this article analyzes the impediments to its realization. Noting the institutional fragmentation that surrounds open space conservation, the article discusses the governmental and private sector bodies that implement actions designed to achieve it. The article argues that open …

Resolving Alj Removal Protections Problem Following Lucia, Spencer Davenport May 2020

Resolving Alj Removal Protections Problem Following Lucia, Spencer Davenport

University of Michigan Journal of Law Reform

When the Supreme Court decided Lucia v. SEC and held that administrative law judges (ALJs) are Officers under the Constitution, the Court opened a flood of constitutional issues around the status of ALJs and related government positions. One central issue relates to ALJs’ removal protections. ALJs currently have two layers of protection between them and the President. In an earlier Supreme Court decision, the Court held that two layers of tenure protection between an “Officer of the United States” and the President was unconstitutional as it deprived the President the power to hold his officers accountable. As impartial adjudicators, ALJs …
