The article focuses on determination of whether a purported class action meets the requirements for class certification under Louisiana's class action procedures. Two Louisiana Supreme Court cases discussed include Price v. Martin, in which the Court granted certiorari to review whether the lower courts correctly applied the commonality requirement and Alexander v. Norfolk Southern Corp, dealing with chemical spill. Standards of review distribute power within the judicial branch by defining the relationship between trial and appellate courts. These standards “frame the issues, define the depth of review, assign power among judicial actors, and declare the proper materials to review.” Standards of review are the cornerstones of appeals. These standards must be woven into the discussion of the facts and substantive law in a manner which persuades the appellate court that the trial court erred. Should They Stay Or Should They Go: Applying The Forum Non Conveniens Doctrine To Foreign Plaintiffs Injured Abroad In Abad V. Bayer Corporation, Leah B. Moon
Seventh Circuit Review
To prevent plaintiffs from harassing the defendant or engaging in forum-shopping, the common law doctrine of forum non conveniens permits trial courts to dismiss a foreign plaintiff's suit, over which it would normally have jurisdiction, if both the parties' convenience and the ends of justice are best served by dismissal. Supreme Court precedent requires courts to weigh a number of private and public interest factors, and gives foreign plaintiffs less deference in their choice of forum than a domestic plaintiff. The thesis offered in this Article, marking three different stages in the development of the personal jurisdiction doctrine of Israeli courts toward the PT of the West Bank and the Gaza Strip, has two additional attributes. One concerns the doctrinal innovation in the general personal jurisdiction doctrine of Israeli courts that also took place as these different stages unfolded. Medical Malpractice Overseas: The Legal Uncertainty Surrounding Medical Tourism, Philip Mirrer-Singer
Law and Contemporary Problems
Mirrer-Singer explores some of the legal uncertainty surrounding medical tourism specifically in ways medical tourists can seek relief in US courts for malpractice committed abroad and explains why courts probably lack jurisdiction over foreign physicians who have allegedly committed malpractice. Among other things, he discusses theories under which US firms in the medical-tourism business could be held liable for the foreign provider's negligence.

Justice Required: Using A Preservation-Of-Court-Access Approach To Forum Non Conveniens In Five International Product-Injury Case Studies, Jeffrey A. Van Detta

The American federal courts have used a questionable common law procedural rule to erect a virtually impenetrable barrier for those injured in other countries by products or industrial activities of U.S.-based multinationals. This barrier exists as the forum non conveniens ("FNC") rule. Section II briefly reviews the current problems that the FNC rule causes and explains its origins. In Section III, I describe my doctrinal shift away from the FNC rule to a preservation-of-court-access statute. I demonstrate in Section IV, the focus of the article, how applying that statute would change the outcome of actual product injury cases filed by …
