Changing The Modal Law School: Rethinking U.S. Legal Education In (Most) Schools, Nancy B. Rapoport Oct 2017

Changing The Modal Law School: Rethinking U.S. Legal Education In (Most) Schools, Nancy B. Rapoport

Dickinson Law Review (2017-Present)

This essay argues that discussions of educational reform in U.S. law schools have suffered from a fundamental misconception: that the education provided in all of the American Bar Association-accredited schools is roughly the same. A better description of the educational opportunities provided by ABA-accredited law schools would group the schools into three rough clusters: the “elite” law schools, the modal (most frequently occurring) law schools, and the precarious law schools. Because the elite law schools do not need much “reforming,” the better focus of reform would concentrate on the modal and precarious schools; however, both elite and modal law schools …

An American Oddity: The Law, History, And Toll Of The School District, Nadav Shoked Jun 2017

An American Oddity: The Law, History, And Toll Of The School District, Nadav Shoked

Northwestern University Law Review

The school district is a staple of American law. As the local government tasked with controlling our public schools, the school district is so well-entrenched that lawmakers and commentators ignore its uniqueness as a legal institution. The school district is peculiar to American law, and it is a peculiarity within American law. General purpose governments—cities and counties—are the local governments controlling schools outside the United States. In the United States itself, these governments control almost all other major local functions. But they do not control education here. Why? Why does American law rely on a separate local government for the …

Minimum Education Requirements For Crime Scene Investigators, Araseli Saldivar May 2017

Minimum Education Requirements For Crime Scene Investigators, Araseli Saldivar

Themis: Research Journal of Justice Studies and Forensic Science

The initial crime scene investigation is critical since it is the primary step in the investigative process; therefore, individuals assigned to process a scene should be highly educated. Improperly educated (or uneducated) crime scene investigators (CSIs) can mishandle evidence during an investigation, affecting the outcome of cases. The minimum education requirement for CSIs should transition from a high school diploma—the current requirement—toward a bachelor’s degree. The importance of acquiring a college-level education is observed in a study conducted on crime scene examiners in Australia. To determine the educational requirement for CSIs in the United States, information was gathered electronically from …

Demography In America: Gifted Education For A Growing Population Of English Language Learners, Lisa P. Wiggin May 2017

Demography In America: Gifted Education For A Growing Population Of English Language Learners, Lisa P. Wiggin

Indiana Journal of Law and Social Equality

Most states are experiencing growth in their numbers of public-school students with limited English proficiency. Although many of these students possess the cognitive abilities to warrant placement in gifted programs, they are frequently overlooked in the identification process. As the United States economy increasingly relies on highly-educated workers, it becomes imperative to give our brightest students opportunities to develop their true academic potential, despite the fact that their English-language fluency is still developing. Three states already recognize the need to identify English Language Learners for gifted-education programs, and their policies offer examples to other states hoping to address this challenge.

The Secular Benefits Of Comparative Religious Education, Wen Jie (Fred) Tan Apr 2017

The Secular Benefits Of Comparative Religious Education, Wen Jie (Fred) Tan

Brigham Young University Prelaw Review

This paper builds on current literature surrounding the need for increased religious freedom. Theories on conflict and threat describe how peace and religious freedom must be preceded by religious understanding. However, it is erroneous and presumptuous to claim that such religious understanding will increase naturally without intentional policies facilitating a climate tolerance and acceptance. Taboos limit governments' interaction with religion. It will be shown how secular benefits that religious freedom brings provide strong justification for cooperation between both institutions. A policy of comparative religious education improves mutual religious understanding and helps bring about increased economic growth and national security. Because …

International Relations: Politics, Economics, Law

Clinical legal education isan additional burden on curators, which so far has not been taken into account anywhere. This education also requires financial expenses, including stationery, educational and specialized literature, periodicals, updating of legal information systems, maintenance of office equipment, etc. Like any innovative activity, a legal clinic requires effort and investment and only then can demonstrate a positive result. The functioning of the legal clinic of the UWED confirms the undeniable truth: we will get good specialists - future conductors of the policy of our state both in the country and abroad, if we apply such a proven method …

Embracing Race-Conscious College Admissions Programs: How Fisher V. University Of Texas At Austin Redefines "Affirmative Action" As A Holistic Approach To Admissions That Ensures Equal, Not Preferential, Treatment, Nancy L. Zisk Jan 2017

Embracing Race-Conscious College Admissions Programs: How Fisher V. University Of Texas At Austin Redefines "Affirmative Action" As A Holistic Approach To Admissions That Ensures Equal, Not Preferential, Treatment, Nancy L. Zisk

Marquette Law Review

In Fisher v. University of Texas at Austin, the United States Supreme Court affirmed well-established Supreme Court doctrine that race may be considered when a college or university decides whom to admit and whom to reject, as long as the consideration of race is part of a narrowly tailored holistic consideration of an applicant's many distinguishing features. The Court's latest decision heralds a new way of thinking about holistic race-conscious admissions programs. Rather than considering them as "affirmative action" plans that prefer any one applicant to the disadvantage of another, they should be viewed as the Court has described …
